CSA -Bay Trail Shoreline Riprap Repairs 2 October 19, 2009 <br />Board (RWQCB). ESA was selected due to its extensive experience with the San Leandro <br />marshlands and in handling permit applications that require mitigation measures involving <br />special status species. <br />Analysis <br />Due to the requirements associated with the presence of federally-listed species, a qualified <br />USF&WS approved biological monitor is required to be present during all activities related to <br />the project. To meet the regulatory agency time constraints, City staff recently entered into a <br />Consulting Services Agreement (CSA) in the amount of $47,537 with ESA to provide a portion <br />of the biological monitoring services during construction. However, additional compliance <br />monitoring is required. This CSA amendment will increase the cost by $24,936, bringing the <br />total cost of the CSA to $72,473. <br />Current City Council Policy <br />Regular maintenance of City facilities to ensure safe and efficient operation. <br />Previous City Council Action(s) <br />+ On January 9, 2006, by Resolution No. 2006-005, the City Council ratified the declaration of <br />local emergency by the Director of Emergency Services resulting from the winter storms of <br />2005-06 <br />• On April 2, 2007, by Resolution No. 2007-044, the City Council approved a contractual <br />services agreement with Environmental Science Associates (ESA) relating to the subject <br />project <br />+ On September 8, 2009, by Resolution No. 2009-125, the City Council approved the <br />appropriation of grant funds for the subject project <br />City Council Committee Review and Action <br />Not Applicable <br />Appiicable General Plan Policy <br />Goal 29 -Mitigation of Natural Hazards <br />Permits and/or Variances Granted <br />Permits from the following agencies have been obtained: <br />+ U.S. Army Corps of Engineers Permit <br />• San Francisco Bay Conservation and Development Commission <br />• San Francisco Bay Regional Water Quality Control Board <br />
