City Council Rules and Communications Committee <br />October 27, 2009 <br />Page ~3 <br />There was consensus by the Committee to change the required distance from any school to 300 feet. <br />Ms. Ornelas suggested striking out the section dealing with multi-unit housing, to allow more time <br />for further direction from the Committee and further discussion with the Rental Housing Owners <br />Association (RHO) to resolve the many areas of discrepancy. There was consensus by the <br />Committee to do so. <br />Ms. Ornelas stated that she would like to move forward with other requirements of the ordinance, <br />such as those dealing with smoking in the workplace. She indicated that the most effective means <br />of notifying businesses of the new Smoking Ordinance is to include the information in the business <br />license renewal notices, which will be mailed in a few weeks. <br />Torn Silva, from the RHO, reminded the Committee that the enclosed common areas of multi-unit <br />housing are considered workplace areas for the resident manager. Mr. Silva stated that, under the <br />proposed Smoking Ordinance, these areas would be required to be smoke free, and the RHO agrees. <br />Ms. Ornelas indicated that she would add the definition of "enclosed common area" back into the <br />Ordinance. <br />Serena Chen, from the American Lung Association, commented that the smoking restrictions for <br />child care facilities could be more explicit in the Ordinance. Ms. Chen commented on studies <br />performed on the health issues related to third-hand smoke. <br />Dolores Tejada, from Community Resources for Independent Living (CRIL) and the Disability <br />Action Network, commented that social norms determine when and where people smoke, and she <br />stressed the importance of dialogue between City staff and the residents of multi-unit housing. Ms. <br />Tejada stated her hopes for a community meeting, and offered to facilitate such a meeting. <br />Beatrice Cardenas-Duncan, a volunteer with the American Heart Association, thanked the <br />Committee for taking steps to protect the public from the dangers of exposure to second-hand <br />smoke. Ms. Cardenas-Duncan commented on the effectiveness of San Francisco's smoking <br />ordinance. <br />Committee Recommendation <br />Schedule the draft Smoking Ordinance for City Council consideration. <br />3. Continued Discussion Regarding Project Labor Agreement <br />Mr. Hollister reported that there is no city comparable to San Leandro that has a comprehensive <br />Project Labor Agreement (PLA) in place, and staff is not comfortable making a recommendation <br />on the subject. <br />Chair Santos stated that both sides have agreed to table the matter for now. <br />
