to any person or damage to or destruction of property, including the loss of <br />use thereof, arising from each occurrence. Such insurance is to be <br />endorsed to include the County and its officers and employees as <br />additional insured as to all services performed by CONTRACTOR under <br />this Agreement. <br />B. Workers' Compensation. Workers' compensation insurance coverage for <br />its employees. <br />C. All Risk Insurance. All Risk Property Damage Insurance including <br />Builders Risk and Flood Plain Insurance whenever applicable, particularly <br />where CDBG funds are used in the acquisition of real property. <br />D. Additional Provisions. The policies are to include a provision for thirty <br />(30) days written notice to County before cancellation or material change <br />of the above specified coverage. Said policies are to constitute primary <br />insurance as to the County, the State and federal governments, their <br />officers, agents, and employees, so that other insurance policies held by <br />them or their self-insurance program(s) are not required to contribute to <br />any loss covered under CONTRACTOR's insurance policy or policies. <br />CONTRACTOR shall carry sufficient insurance coverage to protect <br />Project assets from loss due to theft, fraud and/or undue physical damage, <br />and at a minimum Contractor shall purchase a blanket fidelity bond <br />covering all employees in an amount equal to cash advances from the <br />County. Not later than the commencement date of the Agreement, <br />CONTRACTOR shall provide the County with a certificate(s) of <br />insurance evidencing the above liability insurance. <br />In addition, CONTRACTOR shall comply with the bonding and insurance requirements <br />of OMB Circular A-110, Bonding and Insurance. See Exhibit C for more information. <br />VII. SUBCONTRACTS <br />A. Any subcontract funding under this Agreement shall be submitted to County for <br />review and approval prior to its execution. <br />B. In the event subcontractor is a private non-profit or neighborhood-based non- <br />profit organization, or a local development or small business investment <br />corporation, contractor is required to comply with the procurement procedures of <br />Office of Management and Budget (OMB) Circular A-110 and A-122 <br />(incorporated herein by reference) for the procurement of supplies and services in <br />connection with activities funded under this Agreement. <br />C. Any subcontract funded under this Agreement shall be subject to the terms and <br />conditions of this Agreement. <br />VIII. BUDGET <br />10 of 55 <br />
