Hollister <br />City Manager <br />Kathy Ornelas, Community Relations Representative <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />AN ORDINANCE OF THE CITY OF SAN LEANDRO REPEALING CHAPTER 4-12 OF <br />THE SAN LEANDRO MUNICIPAL CODE, AND ADOPTING A NEW CHAPTER 4-12 <br />PROHIBITING THE USE OF TOBACCO PRODUCTS IN OR AROUND WORKPLACES, <br />PUBLIC PLACES, RECREATIONAL AREAS AND FACILITIES <br />SUMMARY AND RECOMMENDATION <br />It is recommended that Chapter 4-12 of the San Leandro Municipal Code be amended to <br />strengthen the regulations regarding smoking in public places, places of employment, <br />recreational areas and athletic facilities in San Leandro. <br />BACKGROUND <br />In January of 2009, the American Lung Association sent a report to the City Council, ranking <br />San Leandro's smoking regulations with the other Cities in Alameda County. Since San <br />Leandro's smoking regulations had not been changed in a number of years, except to be <br />compliant with State laws regarding smoking in places of employment, the Lung Association <br />asked the City to consider strengthening its ordinances in light of the growing evidence of health <br />effects from secondhand smoke. The Lung Association also asked the City to consider enacting <br />restrictions on smoking in multi-family housing. <br />The matter was referred to the City Council Rules and Communications Committee which, in <br />turn, tasked staff with drafting new regulations regarding smoking in San Leandro. Staff <br />compiled a number of ordinance elements from various Cities around the Bay Area, as well as <br />from a model secondhand smoke ordinance published by the Technical Assistance Legal Center <br />in Oakland. <br />After several discussions at Rules and Communications Committee meetings, the Committee <br />recommended that revisions to the San Leandro Municipal Code be brought forward for City <br />Council consideration. Initial drafts included restrictions on smoking in residential units of <br />multi-family buildings. However, those restrictions will require further input from the <br />community before being brought for City Council consideration. <br />The City's annual Business License Renewal notices are sent out to all business license holders <br />in December.
