Smoking Ordinance 3 December 7, 2009 <br />City Council Committee Review and Action <br />This item has been discussed by the City Council Rules and Communications Committee at its <br />February 5, March 24, May 26 and October 27, 2009 meetings. <br />Summary of Public Outreach Efforts <br />• Representatives of the Rental Housing Owners Association, Alameda County Health <br />Department Tobacco Control Program, American Lung Association, and other interested <br />community members have participated in discussions at the City Council Rules and <br />Communications Committee meetings. In addition, the Mayor and staff have met directly <br />with representatives of the Rental Housing Owners Association. <br />• Superintendents of both School Districts have been consulted regarding the restrictions <br />related to smoking near school properties. Both Superintendents recommended the distance <br />from any school be 1,000' to be consistent with Crime Free Zones in San Leandro. <br />However, the Rules and Communications Committee felt this would be a hardship on <br />teachers and classified employees at schools, and set the distance at 300'. <br />• The Executive Director of the Chamber of Commerce asked his Executive Board for <br />comments and none were received. Although, John Gooding from Madison Marquette <br />indicated his company is in favor of the restrictions of smoking in public areas, including <br />shopping malls. <br />• Smoking would be permitted in up to twenty-five percent (25%) of hotel and motel guest <br />rooms, although both the San Leandro Marina Inn and the Hilton Garden Inn are completely <br />non-smoking establishments. <br />Fiscal Impact <br />The only direct cost associated with this ordinance change, other than staff time for public <br />education and enforcement, will be to install signs in City parks and athletic facilities to natify <br />park users that smoking is prohibited in all parks and athletic facilities. The total cost for the <br />signs is estimated at $6,200. As there is no budget for this expenditure, it is recommended that <br />the City Manager's Contingency Funds be used. <br />Budget Authority <br />010-14-015-8355--City Manager's Contingency Fund <br />Perry Carter, Fin c irector <br />CONCLUSION <br />It is recommended that the Council pass to print an ordinance, adding a new Chapter 4-12 to the <br />San Leandro Municipal Code to strengthen the regulations regarding smoking in public places, <br />places of employment, recreational area and athletic facilities in San Leandro. <br />
