Permitted Investments and from which amounts may not be released to the Agency unless the <br />amount of Housing Tax Revenues for the current Fiscal Year (as evidenced in the written <br />records of the County) plus Additional Revenues at least equal the requirements for issuance of <br />Parity Debt under Section 3.05(b). <br />"Nominee" means (a) initially, Cede & Co., as nominee of DTC, and (b) any other <br />nominee of the Depository designated pursuant to Section 2.11(a). <br />"Outstanding" when used as of any particular time with reference to Bonds, means <br />(subject to the provisions of Section 9.05) all Bonds except: <br />(a) Bonds theretofore canceled by the Trustee or surrendered to the Trustee <br />for cancellation; <br />(b) Bonds paid or deemed to have been paid within the meaning of Section <br />9.03; and <br />(c) Bonds in lieu of or in substitution for which other Bonds shall have been <br />authorized, executed, issued and delivered by the Agency pursuant hereto. <br />"Owner" or "Bondowner" means, with respect to any Bond, the person in whose name <br />the ownership of such Bond shall be registered on the Registration Books. <br />"Parity Debt" means any additional bonds, loans, advances or indebtedness issued or <br />incurred by the Agency on a parity with the Bonds pursuant to Section 3.05. <br />"Parity Debt Instrument" means any Supplemental Indenture or other instrument <br />providing for the issuance or incurrence of Parity Debt. <br />"Participating Underwriter" has the meaning ascribed thereto in the Continuing <br />Disclosure Certificate. <br />"Permitted Investments" <br />are in compliance with the City's <br />shall be entitled to rely upon <br />certification to the Trustee that tl <br />City's investment policies then in <br />Fair Market Value: <br />(a) Federal Securities; <br />means any of the following which at the time of investment <br />investment policies then in effect (provided that the Trustee <br />any investment direction from the Agency as conclusive <br />ie investments described therein are in compliance with the <br />effect), but only to the extent that the same are acquired at <br />(b) Bonds, debentures, notes or other evidence of indebtedness issued or <br />guaranteed by any of the following federal agencies and provided such <br />obligations are backed by the full faith and credit of the United States of <br />America (stripped securities are only permitted if they have been stripped by <br />the agency itself): (i) certificates of beneficial ownership of the Farmers <br />Home Administration; (ii) Federal Housing Administration debentures; (iii) <br />participation certificates of the General Services Administration; (iv) <br />guaranteed mortgage-backed bonds or guaranteed pass-through obligations <br />of the Government National Mortgage Association; (v) guaranteed Title XI <br />financings of the U.S. Maritime Administration; and (vi) project notes, local <br />authority bonds, new communities debentures and U.S. public housing <br />9 <br />
