Hollister <br />City Manager <br />Kathy Ornelas, Community Relations Representative <br />AMENDMENT OF CHAPTER 4-12 OF THE SAN LEANDRO MUNICIPAL CODE <br />RELATING TO SMOKING POLLUTION CONTROL - LANGUAGE REGARDING <br />DEFINITIONS OF PLACE OF EMPLOYMENT <br />SUMMARY AND RECOMMENDATION <br />On the December 21, 2009 City Council meeting agenda, Consent Calendar item C, the Council <br />will consider adoption of amendments to Chapter 4-12 of the San Leandro Municipal Code. <br />Section 4-12-105(g) of the proposed new code includes examples of some of the places of <br />employment where smoking will now be prohibited. These examples include "enclosed <br />common areas ofmulti-family housing buildings." <br />The Rental Housing Owners Association (RHO) has expressed concern that these areas of multi- <br />family housing buildings are called out in the ordinance. <br />The City Council Rules and Communications Committee and staff have agreed with RHO and <br />members of various non-profit organizations in the community to revisit regulations regarding <br />smoking in multi-family housing buildings in 2010. Therefore, staff recommends that the <br />"enclosed common areas of multi-family housing buildings" language be removed from the <br />amendments to Chapter 4-12 that the City Council will be considering at this time. <br />
