B. All fees and charges related to Environmental Services programs shall be paid
promptly in full. Failure to keep accounts current shall be grounds for revocation of
the conditional use permit.
C. Compressed gas cylinders and tanks shall be secured to prevent falling due to
contact, vibration or seismic activity. See 2007 California Fire Code §3005.5.3 for
acceptable securing methods. Cylinders can also be stored outside in secure gated
and locked enclosures with the exempt amounts listed in the 2007 California Fire
Code Table 2703.1.1(3).
D. All hazardous waste generated on site shall be handled and disposed of pursuant to
applicable local, state and federal law.
E. Discharge of anything to the stormwater collection system other than rainwater,
including street curb and gutter, is strictly prohibited.
F. The elimination of exposure of materials, processes or equipment to the maximum
extent practicable is necessary to prevent contamination of rainwater. Exposures that
cannot be eliminated may require the use of Best Management Practices (BMPs),
both engineered and policy/procedural, to prevent remaining exposures from
impacting rainwater, creating illicit discharges or contaminating receiving surface
waters.
G. The storage of materials, installation of processes and/or equipment outdoors may
place the facility into the IndustriaUCommercial Facility Stormwater program and
require submittal of a Notice of Intent (NOI) to the Regional Water Quality Control
Board. The elimination of exposure to stormwater by relocating indoors, covering or
utilizing other engineered controls is highly recommended. If an NOI filing is
required it must be submitted prior to finaling of the building permit or issuance of
certificate of occupancy. A copy of the NOI shall be provided to the City's'
Environmental Services office.
H. The generation or discharge of wastewaters, other than domestic sewerage, may
require a pretreatment permit for discharge to the sanitary sewer. If a permit is
required, submittal of an application to the City's Environmental Services is required
prior to finaling of the building permit or commencing the discharge; whichever
shall occur first.
I. If the planned site improvements trigger the installation of structural treatment
BMPs under provision C.3 of the ACCWP program WDR; then a Storm Water
Structural Treatment BMP Operation & Maintenance Data Form shall be completed
and submitted to the Engineering Division prior to finaling of the grading permit.
J. If the facility stores petroleum products, including ~ a mixture with 1 % or greater
petroleum component, in quantity equal to or greater than 1320 gallons; as an
aggregate of all individual "tanks" equal to or greater than 55 gallons capacity that
may include aboveground drum, tank, container, tote, oil filled electrical equipment,
oil filled manufacturing equipment and oil filled operational equipment; then the
Conditions of Approval July 16, 2009
PLN2009-00022 Page 7 of 10
