IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION N0.2010-004 (3081) RESOLUTION ADOPTING THE MOST RECENT VERSIONS OF THE STATE MODEL WATER EFFICIENCY LANDSCAPE ORDINANCE TECHNICAL APPENDICES AND STUDIES IN SUPPORT OF ARTICLE 19 OF THE CITY OF SAN LEANDRO ZONING CODE RECITALS WHEREAS, the Water Conservation in Landscaping Act of 2006 (Assembly Bill 1881), was enacted into law by the State of California; and WHEREAS, Assembly Bill 1881 requires that all local jurisdictions within the State of California adopt an ordinance that "meets or exceeds" the requirements of the Department of Water Resources Model Water Efficient Landscape Ordinance (WELO); WHEREAS, the model WELO requires, among other things, that local zoning regulations promote the use of water efficient irrigation, plant selection and drought tolerant landscaping; and WHEREAS, the City of San Leandro resolved in February 2006 to encourage the use of water efficient landscaping, as embodied in the StopWaste.Org protocols, Bay Friendly Landscaping; and WHEREAS, the City of San Leandro adopted its own WELO in 2009, and codified it under Article 19 of the City's Zoning Code; and WHEREAS, in adopting its own WELD the City of San Leandro relied upon the Department of Water Resources Model WELO technical research and appendices. The City desires to continue to rely upon the current and future versions of such technical research and appendices as such updates are released by the State. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: The City Council adopts the California Department of Water Resources WELD technical research and appendices in support of and as back-up information for the City's WELD. BE IT FURTHER RESOLVED, that the City Council authorizes staff to rely upon and use, whenever necessary, the most up to date versions of such technical research and appendices in support of and asback-up information for the City's WELD.
