IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2010-004 (3081) <br />RESOLUTION ADOPTING THE MOST RECENT VERSIONS OF THE STATE MODEL <br />WATER EFFICIENCY LANDSCAPE ORDINANCE TECHNICAL APPENDICES AND <br />STUDIES IN SUPPORT OF ARTICLE 19 OF THE CITY OF SAN LEANDRO ZONING CODE <br />RECITALS <br />WHEREAS, the Water Conservation in Landscaping Act of 2006 (Assembly Bill 1881), <br />was enacted into law by the State of California; and <br />WHEREAS, Assembly Bill 1881 requires that all local jurisdictions within the State of <br />California adopt an ordinance that "meets or exceeds" the requirements of the Department of <br />Water Resources Model Water Efficient Landscape Ordinance (WELO); <br />WHEREAS, the model WELO requires, among other things, that local zoning regulations <br />promote the use of water efficient irrigation, plant selection and drought tolerant landscaping; and <br />WHEREAS, the City of San Leandro resolved in February 2006 to encourage the use of <br />water efficient landscaping, as embodied in the StopWaste.Org protocols, Bay Friendly <br />Landscaping; and <br />WHEREAS, the City of San Leandro adopted its own WELO in 2009, and codified it <br />under Article 19 of the City's Zoning Code; and <br />WHEREAS, in adopting its own WELD the City of San Leandro relied upon the <br />Department of Water Resources Model WELO technical research and appendices. The City <br />desires to continue to rely upon the current and future versions of such technical research and <br />appendices as such updates are released by the State. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />The City Council adopts the California Department of Water Resources WELD technical <br />research and appendices in support of and as back-up information for the City's WELD. <br />BE IT FURTHER RESOLVED, that the City Council authorizes staff to rely upon and use, <br />whenever necessary, the most up to date versions of such technical research and appendices in <br />support of and asback-up information for the City's WELD. <br />
