However, it has been <br />determined that Redevelopment funds cannot be used for "non-permanent" items such as those <br />listed above. Therefore, an alternate funding source is necessary. The previously approved but <br />unused Redevelopment funds will become available for other uses upon completion of the <br />project. <br />Staff analyzed the original list of supplies and reduced the scope of the purchase to $300,000 <br />through a combination of deferring some items, reusing equipment, and substituting lower cost <br />items where possible. This FF&E is necessary for operation of the facility as an EOC. Note that <br />additional, specialized supplies for the EOC are being funded through a separate appropriation in <br />the 2009-2010 fiscal year budget and are in addition to the basic FF&E discussed above. <br />Current City Council Policy <br />The proposed Senior Center project is consistent with the criteria of California Redevelopment <br />Law at Health and Safety Code Section 33445 for the use of RDA funding. <br />California Government Code Section 66001(g) provides that the legal uses of park development <br />fees may include the costs attributable to the increased demand for public facilities reasonably <br />related to a development project in order to (1) refurbish existing facilities to maintain the <br />existing level of service or (2) achieve an adopted level of service that is consistent with the <br />general plan. In this case, the use of the City's Park Development Fees to purchase furniture, <br />fixtures and equipment is consistent with State law and the City's policies related to Park <br />Development Funds because the Senior Center will maintain existing levels of service and allow <br />the City to expand services to meet levels consistent with the City's General Plan. <br />Previous City Council Action(s) <br />On July 28, 2008, by Resolution No. 2008-094, the City Council approved a cooperation <br />agreement between the City of San Leandro and the Redevelopment Agency of the City of San <br />Leandro for the purpose of undertaking redevelopment activities within the Alameda County - <br />City of San Leandro Redevelopment Area at a cost not to exceed Thirteen Million and no/100 <br />Dollars ($13,000,000) to the Redevelopment Agency. <br />
