IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2010-057 RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF EASEMENT TO LIVERMORE AMADOR VALLEY WATER MANAGEMENT AGENCY, A JOINT POWERS AGENCY, DBA LAVWMA, FOR A PORTION OF TWO PARCELS AT APN 080G-0910-002-14 AND APN 080G-1406-031 LOCATED AT SAN LEANDRO BAY TRAIL AND A TEMPORARY PERMIT TO ENTER AND USE PROPERTY AGREEMENT AT APN 080G-0910-002-14, APN 080G-1409-138, APN 080G-0910-002-24 AND APN 080G- 1406-031 FOR LIVERMORE AMADOR VALLEY WATER MANAGEMENT AGENCY'S SEWER PIPELINE REPLACEMENT PROJECT Recitals WHEREAS, the City of San Leandro owns certain real property situated in the City of San Leandro, California, at APN 080G-0910-002-14 APN 080G-1409-138, APN 080G-0910- 002-24 AND APN 080G-1406-031 on the San Leandro Bay Trail (the "Properties") and WHEREAS, Livermore Amador Valley Water Management Agency, DBA LAVWMA, desires to obtain two non-exclusive permanent easements and three temporary construction easements for the installation, maintenance and use of sanitary sewer pipeline, equipment and appurtenances thereto on a portion of the Properties; and WHEREAS, the City of San Leandro has determined it is proper and in the public interest to grant the easements to LAVWMA. NOW, THEREFORE THE CITY OF SAN LEANDRO, DOES RESOLVE, DECLARE AND DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City of San Leandro hereby specifically finds that all of the facts stated above are true and correct. SECTION 2. That the City Manager is hereby authorized to execute a Grant of Easement, substantially in the form attached hereto, to LAVWMA for easements to install, construct, and maintain sanitary sewer pipeline and equipment and appurtenances thereto on a portion of the Property, as described in the attached Grant of Easement and Temporary Construction Easements as described in the attached Right of Way Contract.
