Section 1: That Findings for Project Approval and Development Agreement, as <br />attached to the Staff Report for this Ordinance, are hereby incorporated into this Ordinance, as if <br />set forth fully herein. <br />Section 2: The City Council hereby adopts the related Findings for Project Approval <br />as set forth in EXHIBIT C to the Staff Report for this Ordinance. <br />Section 3: That the Development Agreement between the City Of San Leandro and <br />Kaiser Permanente Hospitals (Kaiser) for the Kaiser Permanente San Leandro Medical Center <br />and Mixed-Use Development Project has been negotiated and voluntarily entered into by the City <br />and Kaiser. <br />Section 4: The Development Agreement for Kaiser Permanente San Leandro Medical <br />Center and Mixed-Use Development Project, as set forth in EXHIBIT F to the Staff Report for <br />this Ordinance, is hereby approved. <br />Section 5: If any provision of this Ordinance or the application thereof to any person <br />or circumstance is held invalid or unconstitutional, the remainder of this Ordinance, including the <br />application of such part or provision to other persons or circumstances shall not be affected <br />thereby and shall continue in full force and effect. To this end, provisions of this Ordinance are <br />severable. The City Council of the City of San Leandro hereby declares that it would have <br />passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof <br />irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, <br />sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable. <br />Section 6: This ordinance shall take effect thirty (30) days after adoption.
