Center and Mixed-Use Development Project, consisting of an approximately 63-acre site located generally between I-880 and Merced Street and between Marina Boulevard and Fairway Drive, is hereby reclassified from the Industrial General District and combined with a Special Review Overlay [IG(SR)] District to Commercial Community with a Planned Development Overlay [CC(PD)] District. Section 4: The City of San Leandro Official Zoning Map is hereby amended as shown on Sheet B2, filed in the office of the City Clerk on May 4, 2010. Section 5: Hospitals and mixed-use retail and residential uses such as proposed under the Project are allowed in the Commercial Community zoning district subject to approval of a Planned Development Project, and that the Kaiser Permanente San Leandro Medical Center and Mixed-Use Development Project's Planned Development demonstrates superior urban design in comparison with the more traditional development under the base Community Commercial district zoning regulations. Section 6: The Kaiser Permanente San Leandro Medical Center and Mixed-Use Development Project's Planned Development permit is hereby approved. Section 7: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder of this Ordinance, including the application of such part or provision to other persons or circumstances shall not be affected thereby and shall continue in full force and effect. To this end, provisions of this Ordinance are severable. The City Council of the City of San Leandro hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable. Section 8: This ordinance shall take effect thirty (30) days after adoption. The City Clerk is directed to publish the title once and post a complete copy thereof on the City Council Chamber bulletin board for five (5) days prior to adoption. ORDINANCE NO. 2010-006 2
