Center and Mixed-Use Development Project, consisting of an approximately 63-acre site located <br />generally between I-880 and Merced Street and between Marina Boulevard and Fairway Drive, is <br />hereby reclassified from the Industrial General District and combined with a Special Review <br />Overlay [IG(SR)] District to Commercial Community with a Planned Development Overlay <br />[CC(PD)] District. <br />Section 4: The City of San Leandro Official Zoning Map is hereby amended as shown <br />on Sheet B2, filed in the office of the City Clerk on May 4, 2010. <br />Section 5: Hospitals and mixed-use retail and residential uses such as proposed under <br />the Project are allowed in the Commercial Community zoning district subject to approval of a <br />Planned Development Project, and that the Kaiser Permanente San Leandro Medical Center and <br />Mixed-Use Development Project's Planned Development demonstrates superior urban design in <br />comparison with the more traditional development under the base Community Commercial <br />district zoning regulations. <br />Section 6: The Kaiser Permanente San Leandro Medical Center and Mixed-Use <br />Development Project's Planned Development permit is hereby approved. <br />Section 7: If any provision of this Ordinance or the application thereof to any person <br />or circumstance is held invalid or unconstitutional, the remainder of this Ordinance, including the <br />application of such part or provision to other persons or circumstances shall not be affected <br />thereby and shall continue in full force and effect. To this end, provisions of this Ordinance are <br />severable. The City Council of the City of San Leandro hereby declares that it would have <br />passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof <br />irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, <br />sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable. <br />Section 8: This ordinance shall take effect thirty (30) days after adoption. The City <br />Clerk is directed to publish the title once and post a complete copy thereof on the City Council <br />Chamber bulletin board for five (5) days prior to adoption. <br />ORDINANCE NO. 2010-006 2 <br />
