2.05. Beneficiary. <br />"Beneficiary" means any one or more person(s) entitled under the provisions of this Plan to <br />receive benefits after the death of a Participant. <br />2.06. Code. <br />"Code" means the Internal Revenue Gode of 1986, as it may be amended from time to time. <br />2.07. Compensation And Includible Compensation. <br />The terms "Compensation" and "Includible Compensation" are defined in this section. <br />A. Compensation. <br />Except as otherwise provided, "Compensation" means: <br />1. Form W-2 Compensation. <br />"Compensation" means wages within the meaning of Code section 3401 (a) and <br />all other payments of compensation to an Employee by the Employer (in the <br />course of the Employer's trade or business) for which the Employer is required <br />to furnish the Employee a written statement under Code sections 6041(d), <br />6051(a)(3), and 6052. Compensation must be determined without regard to <br />any rules under Code section 3401(a) that limit the remuneration included in <br />wages based on the nature or location of the employment or the services <br />performed (such as the exception for agricultural labor in Code <br />section 3401(a)(2)). <br />2. Adjustments To Compensation. <br />For the purpose of determining contributions under the Plan, Compensation <br />shall include only amounts that were paid while the Employee is a Participant. <br />B. Includible Compensation. <br />1. Includible Compensation In General. <br />"Inaudible Compensation" means the Employee's "compensation" as <br />determined under Code section 415(c)(3), including any amount contributed or <br />deferred by the Employer at the election of the Employee that is not includible <br />in the gross income of the Employee under Code section 125, 132(f)(4), <br />402(e)(3), 402(h)(1)(B), 402(k) or 457(b). Compensation shall be determined <br />without regard to any community property laws. <br />2. Differential Wage Payments. <br />"Includible Compensation" shall include differential wage payments to <br />Participants on active duty to the. extent required by the provisions of Code <br />section 414(u)(12)(A)(ii), the Treasury regulations thereunder and any <br />subsequent guidance issued under Code section 414(u)(12)(A)(ii). <br />3 <br />
