Section 6: PROVISION IF NO ONE OR ONLY ONE CANDIDATE FILES. (a) If, by 5:00 p.m. on the 83rd day prior to the November 2, 2010 General Municipal Election, no one or only one person has been nominated for any office of the City of San Leandro, the City Clerk shall submit a certificate of these facts to the City Council, and inform them that they may, at a regular or special meeting held before the November 2, 2010 General Municipal Election, adopt one of the following courses of action: (1) Appoint to the office the person who has been nominated. (2) Appoint to the office any eligible elector if no one has been nominated. (3) Hold the election if either no one or only one person has been nominated. The City Clerk shall publish a notice of the facts described in this section and the available courses of action. Publication shall be made pursuant to Section 6061 of the Government Code in any newspaper of general circulation as designated by the Clerk. The procedures for these appointments or elections shall be conducted in accordance with Elections Code Section 10229. Section 7: PROVISION IF NO ONE OR ONLY ONE PERSON NOMINATED: (a) If, by 5:00 p.m. on the 83rd day before the November 2, 2010 General Municipal Election, no one or only one person has been nominated for any elective office to be filled at that election, and the election is subject to Section 36512 of the Government Code, the City Clerk shall submit a certificate of these facts to the City Council and inform them that they may, at a regular or special meeting held before the November 2, 2010 General Municipal Election, adopt one of the following courses of action. (1) Appoint to the office the person who has been nominated. (2) Appoint to the office any eligible elector if no one has been nominated. (3) Hold the election if either no one or only one person has been nominated. The City Clerk shall publish a notice of the facts described in this section and the courses of action available under this subdivision. Publication shall be made pursuant to Section 6061 of the Government Code in any newspaper of general circulation as designated by the Clerk.
