IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2010-069 <br />RESOLUTION ADOPTING WASTEWATER DISCHARGE RATES AS PUBLISHED IN THE <br />NOTICE OF PROPOSED SEWER AND WASTEWATER TREATMENT RATES FOR <br />FISCAL YEARS 2010-11 THROUGH 2014-15 <br />WHEREAS, the City Council desires to fund the wastewater utility to continue operations <br />and maintenance, as well as capital repairs; and <br />WHEREAS, the City's treatment facility has been in continuous operation for over 70 <br />years, with several major components in need of comprehensive capital improvement; and <br />WHEREAS, the City Council has reviewed the Plant Rehabilitation Project and the <br />associated rate increase; and <br />WHEREAS, the recently completed Wastewater Rate Study includes the construction cost <br />and debt service to fund operations, maintenance and capital repairs; and <br />WHEREAS, funding from the State Revolving Fund requires a rate study and action by <br />governing body of the public agency; and <br />WHEREAS, in accordance with Prop. 218, the City properly noticed affected property <br />owners, held a 45 day protest period and public hearing; and <br />WHEREAS, the City Clerk determined that a majority protest does not exist. <br />NOW, THEREFORE, the City Council of the San Leandro does RESOLVE as follows: <br />That the five year wastewater discharge fees for FY2010-11 through FY2014-15 as noticed <br />and published in the Notice of Proposed Sewer and Wastewater Treatment Rate Increase and Public <br />Hearing, a copy of which is attached, are hereby approved. <br />Introduced by Councilmember Prola and passed and adopted this 21st day of June, 2010, by <br />the following called vote: <br />
