May 25, 2010 -Execution Copy <br />of improvements, equipment, fixtures, and parking structures, and not <br />include streets, utilities and infrastructure cost and shall not include the <br />construction costs associated with the hospital, central utility plant building, <br />outdoor service yard, or any surface parking area. Developer shall have the <br />option of appealing any assessed fee amounts, consistent with existing City <br />regulations. <br />(b) Planning Processing Fees and Charges. Developer shall pay to City <br />planning permit fees and charges at the rate in effect at the time a completed <br />application for the applicable entitlement is submitted to the City. <br />(c) Long Range Planning Fees. Except for any uses in the Retail Project, no <br />Long Range Planning Fees as adopted in the City Fee Schedule shall apply <br />to the Project. For the Retail Project, all development, including residential <br />and commercial uses, shall be subject to the fees in place at the time of <br />building permit issuance. <br />(d) City Environmental Services Fees and Charges. Developer shall pay any <br />applicable fees and charges for City environmental services including, but <br />not limited to, Hazardous Materials Storage, Storage Tank Installation, <br />Hazardous Waste Generators, Wastewater Pretreatment, and identified <br />Miscellaneous Services. <br />(e) Park Development Impact Fees. Developer shall pay to City any required <br />Park Development .Impact Fees for the residential portion of the Project. <br />However, Developer may receive a credit toward the Park Development <br />Impact Fee for construction of park facilities that qualify for such a credit <br />pursuant to San Leandro Municipal Code, Section 7.13.110. <br />(f) Overhead Utility Conversion Fees for Streets in Underground Utility District <br />Master Plan. Developer shall pay the actual cost of undergrounding utilities. <br />(g) Sanitary Sewer Connection Fees. Developer shall pay fees based on the <br />estimated average day of peak month discharge in effect at the time of the <br />sewer connection, consistent with all applicable City laws. <br />(h) Sanitation Services. Developer shall pay applicable Sanitation Services Fees <br />in effect at the time the services are provided. <br />(i) Alameda County Department of Environmental Health Fees. Developer <br />shall pay any applicable fees for plan review and associated charges imposed <br />by the Environmental Protection Division of the Alameda County <br />Department of Environmental Health. <br />(j) School District Fees. Developer shall pay any applicable school district fees <br />to the San Leandro or San Lorenzo Unified School District, as applicable, <br />estimated by Kaiser to be $334,170 for Kaiser Phase 1.
