CITY OF SAN LEANDRO <br />CITY COUNCIL RULES AND COMMUNICATIONS COMMITTEE <br />June 22, 2010 <br />Code Enforcement and Weed Abatement Hearings <br />HISTORY <br />2002—Code Enforcement Ordinance adopted <br />• Specified that a Hearing Board comprised of City Staff (Administrative Hearing Body) <br />would be convened to hear violations of the Ordinance, and for appeals to penalties <br />and/or abatement orders resulting from enforcement actions <br />• Generally, the hearings were related to violations of the Community Preservation <br />Ordinance and Weed Abatement Ordinance, but could be related to Zoning Code and <br />other Code violations <br />2007—Board of Zoning Adjustments (BZA) made official hearing body for violation and appeal <br />hearings for Code Enforcement and Weed Ordinance violations <br />• Eliminated the need for the Administrative Hearing Body <br />2009—Administrative Hearing Body re-established to hear violations and appeals of Weed <br />Abatement Ordinance <br />To expedite enforcement of Weed Abatement Ordinance <br />Pool of available hearing officers has been expanded <br />Decisions are appealed to the City Manager <br />2010—BZA meeting schedule reduced from twice per month to once per month <br />ISSUES <br />• Code Enforcement hearings are less timely due to reduction in # of BZA meetings <br />• BZA hearings are held in the evenings, resulting in staff overtime <br />• Formality of BZA hearings requires additional staff preparation <br />• BZA decisions are appealable to the City Council <br />
