IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2010-087 <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN AND FILE FINANCING <br />AGREEMENT WITH THE STATE WATER RESOURCES CONTROL BOARD (SWRCB) <br />FOR THE WATER POLLUTION CONTROL PLANT (WPCP) REHABILITATION <br />PROJECT; PROJECT NO. 593-52-239 <br />Recitals <br />BE IT RESOLVED by the City Council of the City of San Leandro that the City Manager <br />is hereby authorized and directed to sign and file, for and on behalf of the City of San Leandro, a <br />Financial Assistance Application for a financing agreement from the State Water Resources <br />Control Board for the construction of the Water Pollution Control Plant Rehabilitation Project; <br />Project No. 593-52-239; and <br />BE IT RESOLVED that the City of San Leandro hereby agrees and further does <br />authorize the aforementioned representative or his designee to certify that the City has and will <br />comply with all applicable state and federal statutory and regulatory requirements related to any <br />financing or financial assistance received from the State Water Resources Control Board; and <br />BE IT FURTHER RESOLVED that the City Manager or his designee of the City of San <br />Leandro is hereby authorized to negotiate and execute a financial assistance agreement from the <br />State Water Resources Control Board and any amendments or change orders thereto and certify <br />financing agreement disbursements on behalf of the City of San Leandro. <br />Introduced by Councilmember Prola and passed and adopted this 6th day of July, 2010, <br />by the following called vote: <br />Members of the Council: <br />AYES: Councilmembers Gregory, Prola, Reed, Souza, Starosciak; Mayor Santos (6) <br />NOES: None (0) <br />ABSENT: Councilmember Stephens (1) <br />II1'. <br />ATTEST: ~I~~.~1,~~n. o ,C~t~~l~ <br />Marian Handa, City Clerk <br />
