i <br />~l <br />CITY OF SAN LEANDRO <br />SUBDIVISION IMPROVEMENT AGREEMENT <br />(PUBLIC IMPROVEMENTS) <br />THIS AGREEMENT, executed in triplicate, for purposes of identification dated Feb. 20 , 2001 , <br />is made and entered into by and between the City of San Leandro, a municipal corporation of the State of <br />California, hereinafter referred to as "City," and San Leandro Investors, a California Limited Liability <br />Company, whereby the general contractor, SCS Development Company, a California corporation DBA <br />Citation Homes Central (hereinafter designated as "principal and Subdivider"), <br />RECITALS <br />A. Subdivider has presented to City a certain final map or parcel map of a proposed subdivision of <br />land located within the corporate limits of the City of San Leandro. <br />B. The proposed subdivision of land is commonly known and described as Improvement Plans <br />Tract 7i75 -Cherry Wood (Phase 3), San Leandro, Alameda County, California, portion of APN 075- <br />0155-001-02, 002-11, 002-12, 002-08, 002-02, 004 and 075-0207-001, 003-01, 004-00, 005-01, 006-01, <br />006-04, 007-01, 007-02, 007-03, 008-02, and bears the Subdivision Map Tract No. 7175. Said <br />subdivision is hereinafter referred to as "the subdivision." <br />C. The map of the subdivision was filed with the City Engineer for presentation to theCity Council <br />of City for its approval which map is referred to and incorporated herein. <br />D. Subdivider has requested approval of the map prior to the construction and completion of <br />improvements including, but not limited to, streets, highways or public ways, public utility facilities and <br />other facilities which are part of or appurtenant to the subdivision that are required by the Subdivision Map <br />Act, the Subdivision Regulations of City, the Vesting Tentative Map (and approvals given in connection <br />therewith) and final grading plan, if any, heretofore approved by City.
