SAN LEANDRO ADMINISTRATIVE CODE <br />TITLE 12 PUBLIC WORKS <br />Chapter 5 Uniform Wastewater Discharge <br />Regulations <br />Markets/Foods 4.15 <br />Mortuaries 3.60 <br />Restaurants 4.10 <br />All Other 2.10 <br />Institutional <br />Schools 1.65 <br />All Other 2.05 <br />(c) For Classification C Users. Industrial and other large users shall be <br />assessed user charges based on measured discharges of wastewater flow, <br />BOD, and SS. Such measurement shall be obtained from monitoring <br />facilities installed on private property at the points of discharge to the sewer <br />system, unless another location is approved by the Manager. Both <br />installation and operating costs of the monitoring facilities shall be at the sole <br />expense of the user. Frequency of monitoring shall be determined by the <br />Manager. Sampling and testing shall be performed by City staff and shall be <br />paid for by the user in accordance with San Leandro Administrative Code <br />Section 6.4.100. In the event that City staff are unable to take samples and <br />make tests during a billing period, an average of the test results for the prior <br />twelve month period shall be used to estimate BOD and SS discharges for <br />the billing period. The Manager shall have the discretion of not using an <br />unusually high measurement if it is judged to be unrepresentative of a user's <br />long-term use of the wastewater system and/or can be explained by a one- <br />time event. <br />User charges shall include a demand charge and a loading charge. Demand <br />charges shall be based on the average day (using normal work days) for the <br />peak month discharge for the prior fiscal year or on an estimate of peak <br />month parameters as provided for in subparagraph (d) below. If a User <br />elects to submit an estimate of this peak month .demand rather than use the <br />prior year's peak month, the User must demonstrate to the Manager's <br />satisfaction that the User has or will soon implement substantial changes in <br />plant processes which are likely to result in substantial reductions in the peak <br />month discharge. Otherwise, the prior year's peak month demand shall be <br />used to assess demand charges for the following fiscal year. The monthly <br />demand charge will remain constant throughout the fiscal year except as <br />provided for in subparagraph (d) below and shall be obtained by multiplying <br />the quantity of each billing parameter (for the average day of the peak <br />month) by the appropriate unit cost shown below. <br />03-OS-O1 <br />
