4 <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2001- 70 (1228) <br />RESOLUTION APPROPRIATING FUNDS AND AUTHORIZING THE CITY MANAGER <br />TO NEGOTIATE A CONSTRUCTION CONTRACT WITH THE ARMY CORPS OF <br />ENGINEERS CONTRACTOR FOR DREDGING AT THE SAN LEANDRO MARINA, <br />PROJECT NO.O1-597-57-168 <br />RECITALS <br />WHEREAS, the U.S. Army Corps of Engineers will perform maintenance dredging of <br />the Jack D. Maltester Channel in June and July of 2001 using approximately $1.5 million dollars <br />of federal funding; and <br />WHEREAS, the City has the opportunity to save costs by retaining the same contractor to <br />perform Marina and channel maintenance dredging as well as dredging of small areas outside the <br />federal channel to provide safe boating access; and <br />WHEREAS, awarding the dredging contract for the City's work using public bidding <br />would result in greater cost and expense to the City and is consequently impractical and <br />undesirable and the City shall negotiate a fair, just, and equitable price for the dredging contract. <br />NOW, THEREFORE, the City Council of the City of San Leandro does resolve as <br />follows: <br />1. The City Council of the City of San Leandro hereby appropriates funds of <br />$210,000 from the Marina Enterprise Fund to perform Marina and channel maintenance <br />dredging and dredge small areas outside of the federal channel to provide safe boating access. <br />2. Pursuant to its authority under Section 1-5-240 of the San Leandro Municipal <br />Code, the City Council hereby authorizes the City Manager to negotiate a dredging contract with <br />the federal contractor retained to perform dredging work on behalf of the Army Corps of <br />Engineers to perform dredging work for the City at a fair, just, and equitable price. <br />
