` - ~ IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2001- 9l. (1428/1099). <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT <br />CONCERNING THE REVISED ZONING CODE DATED JULY 2, 2001 <br />WHEREAS, proposed revisions to San Leandro's Zoning Code have been presented to <br />the City Council of the City of San Leandro ("City Council"); and <br />WHEREAS, said revisions have been through an extensive process of public hearings and <br />community meetings, wherein certain modifications to the proposed Zoning Code have been <br />recommended to the City Council; and <br />WHEREAS, the Department of Development Services of the City of San Leandro has <br />prepared an initial study, and addendum to the initial study, regarding the above-referenced <br />modifications, along with a Negative Declaration of environmental impact pursuant to the California <br />Environmental Quality Act; and <br />WHEREAS, the San Leandro Planning Commission, having reviewed the Negative <br />Declaration of environmental impact prepared in connection with the proposed revisions to the <br />Zoning Ordinance, has recommended to the City Council that said revisions be approved; and <br />WHEREAS, the City Council has reviewed and considered the Negative Declaration, and <br />have determined that it has been completed by the Department of Development Services of the <br />City of San Leandro in compliance with the requirements of the California Environmental Quality <br />Act; and <br />WHEREAS, no comments were received concerning the Negative Declaration during the <br />public review and comment period; and <br />WHEREAS, the Negative Declaration, based on the Initial Study Checklist Form, and the <br />addendum thereto, prepared in connection therewith, concludes that the proposed Zoning Code <br />revisions will have no significant effect on the area's resources, cumulative or otherwise, and <br />furthermore concludes that implementation of the proposed Zoning Code revisions would either <br />result in no environmental impacts, or impacts that are considered less than significant without <br />mitigation; and <br />WHEREAS, the office of the Department of Development Services is located at 835 E. 14tH <br />Street, San Leandro, California, and it is the custodian of the documents or other materials forming <br />the basis for this determination. <br />NOW, THEREFORE, the City Council of the City of San Leandro resolves as follows: <br />The City Council, having reviewed the whole record before it on this matter and having <br />considered the Negative Declaration prepared in connection with the proposed Zoning Code <br />revisions, on that basis finds that the Negative Declaration reflects the independent judgment of the <br />City of San Leandro, and additionally finds that there is no substantial evidence that the project will <br />have a significant effect on the environment; <br />
