Contractors shall prepare and submit all reports, written studies and other printed material on recycled paper to the extent it is available at equal or less cost than virgin paper. 15. LIMITS OF LIABILITY. Neither the professional activities of contractor, nor the presence of Contractor's employees or sub-contractors at the construction/project site(s), shall relieve the General Contractor(s) of their obligations, duties and responsibilities including, but not limited to, construction means, methods, sequence, techniques or procedures necessary for performing, superintending and coordinating the Work in accordance with the contract documents and any health or safety precautions required by any regulatory agencies. The City agrees that the General Contractor(s) are solely responsible for job site safety, and warrants that this intent shall be carried out in the City agreement with the General Contractor(s). Given the foregoing, City shall to the fullest extent permitted by law, waive any claim against Contractor, and indemnify, defend and hold Contractor harmless from any claim or liability for injury of loss arising from Contractor's alleged failure to exercise site safety responsibility. City also agrees that the City, Contractor and its sub-contractors shall be indemnified by the General Contractor and shall be made additional insured under the General Contractor's general liability insurance policy and that a Waiver of Subrogation in favor of Contractor will be provided under the General Contractor's Workers Compensation policy. City will require General Contractor to provide evidence of such insurance to Consultant prior to General Contractor beginning work on the project. Exhibit D Page 6 of 6 6/12/95 rev.
