The Martinelli property is located immediately adjacent to <br />the Redevelopment Project area on Marina Boulevard. The Martinelli business will be directly <br />and severely impacted by the proposed development. <br />As explained in detail below, the Redevelopment Agency of the City of San Leandro (the <br />"Agency") has not adequately considered all of the environmental effects of the Redevelopment <br />Project in the proposed Mitigated Negative Declaration ("MND"), and has not complied with the <br />requirements of the California Environmental Quality Act ("CEQA"). This letter serves to <br />object to the MND as detailed below. <br />A. Projects May Not Be Segmented; Cited Exception is Inapplicable. <br />1. Projects May Not Be Segmented. <br />The Agency has improperly segmented out the property located at 936 Marina Boulevard <br />and has not included it in its review under CEQA. (MND p. 1) Because this is against <br />established law, the Agency must analyze the entire project, including the 936 Marina Boulevard <br />property. <br />MRTL~3875~443627.
