,r <br />,~ <br />~OF SRN `~9~0 <br />o CITY OF SAN LEANDRO <br />'~RP08117~ ~a^^• <br />MITIGATED NEGATIVE DECLARATION <br />Notice is hereby given that the City of San Leandro finds that no significant effect on the <br />environment as prescribed by the California Environmental Quality Act of 1970, as amended will <br />occur for the following proposed project: . <br />I. PROJECT DESCRIPTION: <br />The proposed project consists of the following components: 1) a .Disposition and <br />Development Agreement (DDA) for the Agency to sell approximately 3.75 acres to <br />McKevitt Tnc. for an automobile dealership and service center at 467 Marina Boulevard <br />(eastern-most parcel); 2) A DDA for the Agency to sell approximately 3.75 acres to the <br />Anthony A. Batarse Family Trust for an automobile dealership anal service center at-517 <br />Marina.Boulevard, and for the Trust's development of 559-575 Marina Boulevard, 635 <br />(portion) Marina. Boulevard and 765 Marina Boulevard for automobile and/or motorcycle <br />dealerships and service centers and the sale and display of new and used automobiles; 3) <br />An Owner Participation Agreement (OPA) between the Agency and F.H. Dailey Motor <br />Company for an automobile dealership and service center at 936 Marina Boulevard; 4) <br />public improvements in the form-of a new street, sidewalks, curbs acid gutters at 505 <br />Marina Boulevard. <br />For the purposes of the environmental review, the proposed McKevitt dealership site plan,, <br />the proposed Batarse Trust dealership site plan, and the proposed new roadway are the only <br />physical changes addressed. For the properties indicated above as 936 Marina Boulevard, <br />because these properp.es encompasses. less than five acres, future development of the site <br />would be exempt from CEQA review (CEQA Section 15332). In addition, while it is <br />anticipated that the new road will be extended to facilitate the development of properties to <br />the south, it is not known at this time when the road would be fully developed and what <br />uses would occur on the properties to. the south. Accordingly., any future extension of the <br />roadway to :the south will undergo its own environmental review. <br />II. DECLARATION THAT PROJECT NWILL NOT SIGNIFICANTLY AFFECT <br />ENVIRONMENT: <br />With implementation of the recommended mitigation measures, the proposed project will <br />have no significant effect on the area's resources, cumulative or otherwise. <br />III. FI11rDINGS SUPPORTING DECLA.RATION: <br />A. This project is considered an in-fill development and would convert land that is partially <br />.developed with industrial and commercial uses, and has supported various light <br />industrial, residential, and commercial uses over the past 80+ years, to a uses related to <br />
