Or, in the alternative: <br />• Provide unrestricted Right-of -Entry to the Port of Oakland and its consultants to <br />perform the necessary geotechnical investigations and engineering studies; <br />• Provide staff assistance as necessary to facilitate the Port's work; <br />• Provide all existing information including subsurface conditions, as-built <br />information, maintenance records, etc. for these levees; and, <br />• Commit to providing appropriate financial contributions towards the necessary. <br />geotechnical investigations, engineering studies and to the future strengthening <br />improvements to the levees should such studies find them necessary. The Port <br />will be able to provide more detail regarding estimated maximum costs these <br />commitments would require, and allow City staff to review, prior to submitting the <br />amendment for Port Board of Commissioners for approval. If the City is unable or <br />unwilling to fund any improvements to its own levees as may be required, the Port <br />would look to offset sound insulation work reimbursement costs in the amount of <br />the costs associated with the levee work to be done by the Port for the City. <br />To avoid prejudice to the Port the geotechnical investigations and engineering studies <br />should be commenced as soon as possible. <br />
