Or, in the alternative: • Provide unrestricted Right-of -Entry to the Port of Oakland and its consultants to perform the necessary geotechnical investigations and engineering studies; • Provide staff assistance as necessary to facilitate the Port's work; • Provide all existing information including subsurface conditions, as-built information, maintenance records, etc. for these levees; and, • Commit to providing appropriate financial contributions towards the necessary. geotechnical investigations, engineering studies and to the future strengthening improvements to the levees should such studies find them necessary. The Port will be able to provide more detail regarding estimated maximum costs these commitments would require, and allow City staff to review, prior to submitting the amendment for Port Board of Commissioners for approval. If the City is unable or unwilling to fund any improvements to its own levees as may be required, the Port would look to offset sound insulation work reimbursement costs in the amount of the costs associated with the levee work to be done by the Port for the City. To avoid prejudice to the Port the geotechnical investigations and engineering studies should be commenced as soon as possible.
