The Agency's responsibilities under the proposed Agreement are as follows: <br />Acquire the Yokota property for subdivision and conveyance of a portion to <br />Developer. <br />Process a parcel map defining the boundaries of the Site prior to disposition of <br />the Yokota property. <br />C. Developer Responsibilities <br />The Developer's responsibilities under the proposed Agreement are as follows: <br />Purchase the Site for $25.30 per SF, .estimated at $4,256,168 for the <br />approximately 168,228 SF parcel <br />Provide a Preliminary Development Plan calling for development of afull-service <br />automobile dealership of the size and character comparable to that of other <br />automobile dealerships on Marina Boulevard and with a showroom of at least <br />3,000 SF. <br />No later than 60 days from close of escrow, submit a final Development Plan <br />consistent with the Preliminary Development Plan and set forth in drawings and <br />models, with a minimum frontage along Marina Boulevard of 150 feet, a <br />minimum net size of 20,000 SF, a minimum landscaped area of 10 feet width <br />from the back of the sidewalk on the front and side, and a minimum set back <br />from adjacent residential uses of 10 feet. <br />No later than 60 days from close of escrow, submit Construction Plans <br />consistent with the final Development Plan and containing a time schedule for <br />construction. <br />Prior to close of escrow, notify the Agency of the identity of the dealership <br />franchise or franchises to be located on the Site. <br />Conley Consulting Group Page 4 of 10 <br />9-9 Volvo Lavery 33433 10200.003 v5 September, 2001 <br />
