Developer submitted a Development Concept Plan to the Agency on January 3, 2000 consisting of <br />a set of plans illustrating the proposed Improvements on the Site. Developer shall submit to the Agency a <br />Final Development Plan for the Improvements no later than six months after submitting notification of <br />financing commitrnents pursuant to Section 1.03(a). The Final Development Plan is defined as a set of <br />plans setting forth in drawings and models and/or elevations, size and location of buildings, the number <br />and location of parking spaces, the specific treatment and location of all landscaping amenities, the location <br />of all pedestrian and automobile ingress and egress points, the proposed uses of the various portions of <br />the buildings, and the location of other public streets and improvements. The Final Development Plan shall <br />include elevation drawings of all building facades; a site plan drawn at a minimum scale of 1 inch = 20 feet; <br />a color and materials board for all sides of all buildings; photos of cut sheets of major site furnishings and <br />lighting; and drawings of open space areas at a minimum of/.inch =1 foot The Agency shall approve all <br />aspects of architectural design and site development in the Final Development Plan. The Final <br />Development Plan shall be substantially consistent with the Development Concept Plan and the <br />Redevelopment Plan <br />When the Final Development Plan is approved by the Agency, it shall form a part of this <br />Agreement Any material change, modification, revision or alteration of the approved Final Development <br />Plan shall be submitted for approval by the Agency; if not so approved, the approved Final Development <br />Plan shall continue to control. Any proposed material change, modification, revision or alteration shall be <br />approved or disapproved by the Agency within fifteen (15) days of submittal unless the change is major <br />and requires review by the Agency Board, in which case within sixty (60) days of submittal. <br />1.05 Construction Plans. <br />Developer shall submit to the Agency its Construction Plans for the Improvements within six <br />months after notification to the Agency of the Financing Commitments pursuant to Section 1.03(a). The <br />execution of this Agreement, unless such time limit is extended by the Agency or at the discretion of its <br />Executive Director. As used herein "Construction Plans" mean all construction documentation upon which <br />the Developer, and Developer's several contractors, shall rely in building the Improvements (including <br />landscaping, parking, and common and public areas) and shall include, but not necessarily be limited to, <br />final architectural drawings, landscaping plans and specifications, final elevations, building plans and <br />specifications (also known as "working drawings") and a time schedule for construction. The Construction <br />Plans shall be based upon the approved Final Development Plan and shall not materially deviate therefrom <br />without the express written consent of the Agency. <br />1.06 City of San Leandro Approval. <br />Developer shall apply to the City of San Leandro and, diligently pursue, and obtain all permits <br />necessary for the construction of the Improvements. Developer acknowledges that execution of this <br />Agreement by the Agency does not constitute approval by the City of San Leandro, does not limit in any <br />manner the discretion of the City of San Leandro in the approval process, and does not relieve Developer <br />from the obligation to obtain all necessary permits, including building permits. Developer shall promptly <br />pay when due all customary and reasonable fees and charges of the City of San Leandro in connection <br />with the processing and consideration of the City permits and approvals contemplated by this section. The <br />City will attempt to expedite the processing of permits as it does with other customers. <br />
