s <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2000- 20 (1120/1313-B ) <br />RESOLUTION OF THE CITY COUNCIL ADOPTING A MITIGATED NEGATIVE <br />DECLARATION AND A FINDING OF NO SIGNIFICANT IMPACT AND ADOPTING <br />FINDINGS RELATED THERETO FOR APPROVAL OF THE DISPOSITION AND <br />DEVELOPMENT AGREEMENT FOR DEVELOPMENT OF 960 SAN LEANDRO <br />BOULEVARD AS A BUSINESS PARK <br />APN 75-36-52 <br />WHEREAS, the City Council of the City of San Leandro ("City") is required by the <br />Health and Safety Code to approve the Disposition and Development Agreement ("DDA") for <br />the development of a business park utilizing the property at 960 San Leandro Boulevard, San <br />Leandro, and is therefore a responsible agency under the requirements of CEQA and; <br />WHEREAS, an Initial Study and Mitigated Negative Declaration were prepared in late <br />1999 and circulated for public review from December 16, 1999, to January 14, 2000. The City <br />has received copies of the Initial Study and the Mitigated Negative Declaration; and <br />WHEREAS, no written comments were received during the public comment period <br />which concluded on January 14, 2000. <br />NOW, THEREFORE, the City Council of the City of San Leandro does resolve as <br />follows: <br />1. That, pursuant to the California Environmental Quality Act, the City makes the following <br />findings: <br />I. That the City finds that the City Council, acting as responsible agency for the <br />DDA has conducted an independent analysis of the adequacy of the proposed <br />Mitigated Negative Declaration. <br />II. That the City finds that, on the basis of the following specific findings, that the <br />DDA will not have a significant effect on the environment: <br />a. EARTH <br />EFFECT: The project site is a combination of paved, partially paved, and <br />unpaved areas. The property would need to be graded and paved for development <br />of the site. This paving of unpaved surfaces would constitute overcovering of the <br />soil. <br />
