s IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2000- 20 (1120/1313-B ) RESOLUTION OF THE CITY COUNCIL ADOPTING A MITIGATED NEGATIVE DECLARATION AND A FINDING OF NO SIGNIFICANT IMPACT AND ADOPTING FINDINGS RELATED THERETO FOR APPROVAL OF THE DISPOSITION AND DEVELOPMENT AGREEMENT FOR DEVELOPMENT OF 960 SAN LEANDRO BOULEVARD AS A BUSINESS PARK APN 75-36-52 WHEREAS, the City Council of the City of San Leandro ("City") is required by the Health and Safety Code to approve the Disposition and Development Agreement ("DDA") for the development of a business park utilizing the property at 960 San Leandro Boulevard, San Leandro, and is therefore a responsible agency under the requirements of CEQA and; WHEREAS, an Initial Study and Mitigated Negative Declaration were prepared in late 1999 and circulated for public review from December 16, 1999, to January 14, 2000. The City has received copies of the Initial Study and the Mitigated Negative Declaration; and WHEREAS, no written comments were received during the public comment period which concluded on January 14, 2000. NOW, THEREFORE, the City Council of the City of San Leandro does resolve as follows: 1. That, pursuant to the California Environmental Quality Act, the City makes the following findings: I. That the City finds that the City Council, acting as responsible agency for the DDA has conducted an independent analysis of the adequacy of the proposed Mitigated Negative Declaration. II. That the City finds that, on the basis of the following specific findings, that the DDA will not have a significant effect on the environment: a. EARTH EFFECT: The project site is a combination of paved, partially paved, and unpaved areas. The property would need to be graded and paved for development of the site. This paving of unpaved surfaces would constitute overcovering of the soil.
