i I ~ <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2000 - Z1 ~ 1120/ 1313-B j <br />RESOLUTION OF THE CITY COUNCIL APPROVING THE REUSE <br />REPORT REQUIRED BY HEALTH & SAFETY CODE § 33433 AND <br />THE DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN <br />THE CREEKSIDE ASSOCIATES, LLC, AND THE <br />REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />FOR THE DISPOSITION OF PROPERTY AT 960 SAN LEANDRO <br />BOULEVARD AND AUTHORIZING AND APPROVING THE <br />EXECUTION OF A LICENSE AGREEMENT IN CONNECTION <br />THEREWITH (APN 75-36-52) <br />RECITALS <br />WHEREAS, the Redevelopment Agency of the City of San Leandro {"Agency") has <br />negotiated in good faith a Disposition and Development Agreement ("Agreement") between the <br />Agency and Creekside Associates, LLC ("Creekside"); <br />WHEREAS, the Agreement provides for the disposition by the Agency to Creekside of <br />the property at 960 San Leandro Boulevard (the "Property") for a purchase price of Two Million <br />Two Hundred Sixty Five Thousand One Hundred Twenty Dollars ($2?65,120) (the "Purchase <br />Price") and additional consideration under the terms of the Agreement; <br />WHEREAS, Agency has caused to be prepared a report required by Health and Safety <br />Code § 33433 ("Reuse Report") which contains a summary of the Agreement to be entered into <br />between the Agency and Creekside and a summary of the cost of the Agreement to the Agency, <br />and the Agency has made the Reuse Report available for public inspection pursuant to Health <br />and Safety Code § 33433; <br />WHEREAS, the summary of the cost of the Agreement includes: land acquisition costs; <br />the estimated value of the interest to be conveyed determined at the highest and best use <br />permitted under the Plaza 2 Redevelopment Plan; the estimated value of the interest to be <br />conveyed determined at use with conditions, covenants, and development costs required by the <br />sale; and an explanation of why the sale of the property will assist in the elimination of blight; <br />WHEREAS, the Agency has approved and transmitted to the City Council the Reuse <br />Report required by Health and Safety Code § 33433 by Agency Resolution No. 2000 - ; <br />WHEREAS, the City Council has received and has reviewed the Reuse Report required <br />by Health and Safety Code § 33433 and is familiar with the contents thereof; <br />WHEREAS, the City Council has reviewed the Agreement, including without limitation <br />Exhibit F thereto (the "License Agreement"); <br />DOCSOC\707104v2\24258.0001 <br />
