Mayor Corbett said they are familiar <br /> with the situation. Mr. Johnson said property owners are afraid of <br /> eminent domain and the threat of losing their properties. He said this <br /> is a very human issue. He said, if eminent domain were on the ballot, <br /> it would fail. He said there are other properties in town, such as the <br /> boarded -up buildings on Davis Street, that should be subject to eminent <br /> domain. He said eminent domain won't take care of crime at the <br /> Islander Motel. <br /> Mayor Corbett noted part of Davis Street is already in eminent domain. <br /> Harold Weisbrod, 707 Peralta Avenue, said many years ago BART cut his <br /> porch off, and he doesn't think he was paid adequately for what was <br /> given to BART. He said he is part owner of 715 Peralta Avenue and runs <br /> a tow service. He said eminent domain scares him. His nephew works <br /> for a well -known oil company and had a water sample taken; they drink <br /> the water. He's been there for 50 years. <br /> There being no further comments from the public, on motion of Council <br /> Member Polvorosa, seconded by Council Member Myers, with Council Member <br /> Loeffler absent (1), and carried by a majority vote (6), the Public <br /> Hearing was closed. <br /> Mayor Corbett asked which parcels may contain contaminated water. Ms. <br /> Potter discussed the status of cases at 715 and 851 Peralta Avenue and <br /> Cherry City nursery. <br /> In response to questions from Council Member Perry, Ms. Potter said, if <br /> 851 Peralta Avenue is not included under eminent domain, they would <br /> have to pay cleanup costs, and the high cost reduces the incentive to <br /> improve. She said eminent domain allows the City to fund cleanup. She <br /> said she is not aware of any health violations or code enforcement <br /> problems south of Peralta Avenue. She said, if properties are not <br /> included tonight, and a developer wants to develop the nursery and <br /> adjacent properties, the property owners could negotiate on their own <br /> for sale of their properties. If the developer asked for Council <br /> assistance on properties not included, the eminent domain process would <br /> need to commence again, with notification to all 3,500 property owners <br /> in the Joint Project Area. <br /> Council Member Perry asked why 800 Peralta Avenue was included. <br /> Council Members Myers and Galvan said they did not feel it should be <br /> included. <br /> Mayor Corbett asked, if the 19 acres were developed and it was <br /> necessary to add sewers, widen streets, etc., to be able to develop, <br /> would the City have any authority to widen the street, get rights of <br /> way to do improvements, etc. <br />
