• Minutes - San Leandro City Council Meeting - April 15, 1996 Page - 15 - <br /> JOINT CITY COUNCIL /REDEVELOPMENT AGENCY PUBLIC HEARING (continued) <br /> The City Attorney said Redevelopment law requires that a public <br /> hearing be held for the property owner on the Resolution of <br /> Necessity. He noted the Resolution requires five affirmative <br /> votes of the Agency. He said the action authorizes the Agency to <br /> acquire the property by eminent domain but does not terminate <br /> negotiations which have gone on between the property owner and <br /> the Agency. He said the Redevelopment Agency will continue to <br /> negotiate with the property owner for voluntary acquisition. Ms. <br /> Potter noted 1152 Marina Boulevard is a critical component of the <br /> project. <br /> Agency Member Polvorosa asked if the property owner was aware of <br /> the evening's proceedings and all legal matters. Ms. Potter said <br /> the property owner was in the audience. <br /> The hearing was opened to the property owner; the property owner <br /> did not make a statement. <br /> On motion of Agency Member Kerr, seconded by Agency Member <br /> Polvorosa, with Agency Member Loeffler absent (1), and carried by <br /> a majority vote (6), the Public Hearing was closed. <br /> The following Resolution was then introduced: <br /> Resolution No. 96 -15, Resolution of the Redevelopment Agency of <br /> the City of San Leandro Determining That the Public Interest and <br /> Necessity Require the Acquisition of Certain Land and Directing <br /> the Filing of Eminent Domain Proceedings. (2/3 vote required) <br /> (1120) <br /> Introduced by Agency Member Polvorosa, who moved its adoption, <br /> seconded by Agency Member Galvan, with Agency Member Loeffler <br /> absent (1), and carried by a majority vote (6). <br /> 8. Redevelopment Agency Approves Resolution Permitting the Executive <br /> Director to Execute Land Purchase Contract(s) Related to the Form of <br /> the Disposition and Development Agreement. <br /> Resolution No. 96 -13, Resolution of the Redevelopment Agency of the <br /> City of San Leandro Authorizing the Executive Director of the Agency <br /> to Execute Real Property Transactions to Effectuate the Disposition <br /> and Development Agreement Between the Agency and the Batarse Family <br /> Trust for the County of Alameda - City of San Leandro Joint <br /> Redevelopment Project. (1120) <br /> Introduced by Agency Member Polvorosa, who moved its adoption, <br /> seconded by Agency Member Perry, with Agency Member Loeffler absent <br /> (1), and carried by a majority vote (6). <br />
