IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 2001- 02 (1092/1389) AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEE'S RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF SAN LEANDRO The City Council of the City of San Leandro does ORDAIN as follows: Section 1. An amendment to the contract between the City Council of the City of San Leandro and the Board of Administration of the California Public Employees' Retirement System is hereby approved, a copy of said amendment being attached hereto, marked Exhibit, and by such reference made a part hereof as though herein set out in full Section 2. The City Manager of the City of San Leandro is hereby authorized, empowered, and directed to execute said amendment for and on behalf of said City. Section 3. This ordinance will be effective 30 days after adoption pursuant to § 1 -1 -345 of the San Leandro Municipal Code and shall take effect on May 3, 2001, as set forth in particular provisions of the law prescribing the manner of its passage and adoption. This ordinance implements the provisions of a labor contract negotiated in good faith and entered into between the City and its employees' bargaining unit. Said labor contract • requires that the agreement between the California Public Employees' Retirement System and the City be effective May 3, 2001. Failure to provide for an effective date of May 3, 2001 would constitute a breach of the labor agreement and subject the City to uncertain liabilities.
