(2) Class B - Users not covered by Federal Categorical Pretreatment <br /> Standards, but which have the potential to discharge toxic pollutants and must meet the pollutant <br /> limitations set by the San Leandro Wastewater Discharge Ordinance. <br /> (3) Class C - Users that discharge conventional pollutant loads but could by <br /> themselves or combined with flow from another industry overload the treatment plant, causing <br /> the plant to violate NPDES permit limits. <br /> (4) Class D - Users that discharge wastewater from projects not associated <br /> with normal industrial or manufacturing processes. Projects may include but are not limited to <br /> groundwater cleanup, site remediation, trenching, excavation and leachate extraction. <br /> (ae) Manager. Manager shall mean the San Leandro City Manager or his or her <br /> designee. <br /> (af) Mass Emission Rate. Mass Emission Rate shall mean the weight of material <br /> discharged to the sewer system during a given time interval. Unless otherwise specified, the mass <br /> emission shall mean pounds per day of a particular constituent or combination of constituents. <br /> (ag) National Pretreatment Standard. National Pretreatment Standard shall mean any <br /> regulation containing pollutant discharge limits promulgated by the EPA in accordance with <br /> Section 307 (b) and (c) of the Act, which applies to Industrial Users. This term includes <br /> prohibitive discharge limits established pursuant to 40 CFR Part 403.5. <br /> (ah) National Pollutant Discharge Elimination System or NPDES Permit. National <br /> Pollutant Discharge Elimination System or NPDES Permit shall mean a permit issued pursuant <br /> to Section 402 of the Act. <br /> (ai) National Prohibitive Discharge Standard or Prohibitive Discharge Standard. <br /> National Prohibitive Discharge Standard or Prohibitive Discharge Standard shall mean any <br /> regulation developed under the authority of 307 (b) of the Act and 40 CFR, Section 403.5. <br /> (aj) Natural Outlet. Natural Outlet shall mean any outlet into a watercourse, pond, <br /> ditch, lake, bay, ocean, or other body of surface water, or outlet into the ground water. <br /> (ak) New Source. New Source shall mean a facility meeting the definition of a "New <br /> Source" set forth in 40 CFR Part 403.3 (k). <br /> (al) Nuisance. Nuisance shall mean any condition which is injurious to health or <br /> offensive to the senses or an obstruction to the free use of property so as to interfere with the <br /> comfort or enjoyment of life or property or which affects at the same time an entire community <br /> or neighborhood or any considerable number of persons, although the extent of the annoyance or <br /> damage inflicted upon individuals may be unequal. <br /> (am) Pass Through. Pass Through shall mean a discharge which exits the POTW into <br /> waters of the United States in quantities or concentrations which, alone or in conjunction with a <br /> discharge or discharges from other sources, is a cause of violation of any requirement of the <br /> 5 <br />
