(2) A temporary moratorium will not adversely affect the orderly development <br /> of property or the preservation of property values because other uses authorized by the existing zoning <br /> ordinance and zoning maps remain available to property owners. <br /> Section 2. Scope. <br /> Businesses that are primarily devoted to the sale of tobacco products are prohibited in all land use <br /> districts of the City. The Development Services Department shall not process any applications for <br /> entitlements including conditional use permits, variances, and zoning approval for business licenses or <br /> building permits for said uses until such time as this ordinance has expired or new zoning ordinances or <br /> maps of the City have become operative, whichever is earlier. <br /> Section 3. Definition of 'Tobacco - related products° <br /> 'Tobacco-related products° are any substance containing tobacco leaf, including, but not limited to <br /> cigarettes, cigars, pipes, tobacco, snuff, chewing tobacco and dipping tobacco; cigarette papers; or any <br /> other instrument or paraphemalia that is designed for the smoking or ingestion of tobacco and products <br /> prepared from tobacco. <br /> Section 4. Definition of °Businesses Devoted Primarily to the Sale or Exchange of Tobacco- <br /> related Products° <br /> °Businesses devoted primarily to the sale or exchange of tobacco-related products° are <br /> businesses with actMties either devoting 20 percent of floor area or display area to, or deriving 75 percent <br /> or more of gross sales receipts from, the sale or exchange of tobacco-related products. <br /> Section 5. Applicability. <br /> This Ordinance shall apply to all applications for businesses devoted primarily to the sale or <br /> exchange of tobacco related products that have not received final approval. Any projects already <br /> submitted for review and that have not received final action shall be denied without prejudice or returned to <br /> the applicant. <br /> Section 6. Environmental Review. <br /> The City Council finds that the adoption of this Ordinance is exempt from environmental review <br /> under the California Environmental Quality Act pursuant to Public Resources Code section 21065 based <br /> on the finding that this Ordinance is not a project within the meaning of Section 15378 of the State CEQA <br /> Guidelines, because it has no potential for resulting in physical change in the environment, directly or <br /> ultimately. <br /> 3 <br />
