WHEREAS, in accordance with Health and Safety Code Section 33488, the Agency <br /> notified the Department of Housing and Community Development of its intent to merge the two <br /> project areas. <br /> WHEREAS, in accordance with Health and Safety Code Sections 33363, the City <br /> Council has evaluated all evidence and testimony for and against the adoption of the Amendment <br /> to the Redevelopment Plan; and <br /> WHEREAS, the condemnation of real property provided for in the Redevelopment Plan <br /> is necessary to the execution of the Redevelopment Plan and adequate provisions have been <br /> made for payment for property to be acquired as provided by law. This finding is based upon the <br /> need to assemble sites for certain public facilities, to assemble developable units for economic <br /> activity and to prevent the recurrence of blight; and <br /> WHEREAS, pursuant to Health and Safety Code Section 33486, the tax increment funds <br /> collected from the former Plaza I Redevelopment Project Area shall first be used to comply with <br /> the terms of any bond resolution or other agreement pledging the taxes from the Plaza I <br /> Redevelopment Project Area, the tax increment funds collected from the former Plaza 2 <br /> Redevelopment Project Area shall first be used to comply with the terms of any bond resolution <br /> or other agreement pledging the taxes from the Plaza 2 Redevelopment Project Area, and any <br /> remaining funds may be used throughout the Plaza Redevelopment Project Area. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> DOES ORDAIN AS FOLLOWS: <br /> Section I: Section I3(A) of the Plaza 2 Redevelopment Plan shall be amended to extend <br /> the authority of eminent domain until July 5, 2009. <br /> Section 2: The Plaza 1 Redevelopment Plan and the Plaza 2 Redevelopment Plan are <br /> hereby merged into one Redevelopment Plan which shall be known as the Plaza Redevelopment <br /> Plan and the Plaza I Project Area and the Plaza 2 Project Area shall heretofore be known as the <br /> Plaza Redevelopment Project Area. <br /> Section 3: This ordinance hereby incorporates the Plaza Redevelopment Plan by reference <br /> and hereby designates the Plaza Redevelopment Plan as the official plan for the Plaza <br /> Redevelopment Project Area. <br /> Section 4: No provisions of the Plaza Redevelopment Plan are amended except as <br /> provided in this Ordinance. <br /> Section 5: All findings made regarding the adoption of the Plaza 2 Redevelopment Plan <br /> and amendments thereto are hereby incorporated by reference. <br /> 2 <br />
