Section 7 -5 -1225: DECISION AND ORDER OF THE BOARD OF <br /> APPEALS. After a full and fair consideration of the evidence and <br /> testimony received at the hearing, the Board of Appeals may <br /> affirm, reverse, or modify the notice and order issued by the <br /> Building Official. A written decision shall be issued by the <br /> Board and shall be posted and served in the manner and upon the <br /> persons specified in Section 7 -5 -1135, within fifteen (15) days <br /> from the date on which the hearing was closed. <br /> The decision of the Board shall contain findings stating in <br /> detail the conditions which render the building or portion <br /> thereof a public nuisance as defined in Section 7 -5 -1115, the <br /> work required to be done, and shall order that the work required <br /> by commenced within fifteen (15) days after service of the <br /> decision or a longer period not to exceed thirty (30) days, if in <br /> the sole determination of the Board, as set forth in its <br /> decision, such longer period is found to be necessary and <br /> appropriate, and a statement that the work be completed within a <br /> reasonable time as determined by the Board. <br /> The decision of the Board shall also state that if the work <br /> required has not been commenced or completed within the time <br /> specified in the decision, the Building Official may cause the <br /> work to be done and the cost hereof levied as a special <br /> assessment against the property. <br /> The findings and decision of the Board of Appeals shall be final <br /> and conclusive in the matter." <br /> Section 3. This ordinance shall take effect July 1, 1999, <br /> pursuant to Section 1- 1- 345(f) of the San Leandro Municipal Code <br /> because it relates to particular provisions of law prescribing <br /> the manner of its passage and adoption and Section 1- 1- 345(b) of <br /> the San Leandro Municipal Code because it relates to the <br /> immediate preservation of the public peace, health or safety by <br /> establishing uniform standards for construction. The City Clerk <br /> is directed to publish the title once and post a complete copy <br /> thereof on the City Council Chamber bulletin board within five <br /> (5) days following its adoption. <br /> 3 <br />
