Whenever all or any portion of the Project Area is developed with low- or <br /> moderate - income housing units, the Agency shall require by contract or other <br /> appropriate means that such housing be made available for rent or purchase to the <br /> persons and families of low or moderate income displaced by the Project. Such <br /> persons and families shall be given priority in renting or buying such housing. <br /> 5. [Section 208.5] Relocation Payments <br /> The Agency shall make fair and reasonable relocation payments as prescribed by the <br /> State Guidelines and the Agency's relocation rules and regulations. If there is any <br /> conflict between the Agency's rules and regulations and the State Guidelines, the <br /> State Guidelines shall control. The Agency may exceed the maximum payments <br /> established in the State Guidelines in accordance with Agency policy establishing the <br /> requirements and conditions for providing excess payments. <br /> I. [Section 209] Public Improvements, and Site Preparation <br /> 1. [Section 209.1] Demolition and Clearance <br /> The Agency is authorized to demolish and clear or move buildings, structures, and <br /> other improvements from any real property in the Project Area as it determines <br /> necessary or convenient to carry out the purposes of the Plan. <br /> 2. [Section 209.2] Removal of Graffiti <br /> The Agency may take any actions within the Project Area that the Agency determines <br /> are necessary to remove graffiti from public or private property upon making a <br /> finding that, because of the magnitude and severity of the graffiti within the Project <br /> Area, the action is necessary to effectuate the purposes of the Plan and that the action <br /> will assist with the elimination of blight. <br /> 3. [Section 209.3] Public Improvements <br /> Subject to the requirements of Health and Safety Code Section 33445, the Agency is <br /> authorized to pay all or a part of the value of the land for and the cost of the <br /> installation and construction of any building, facility, structure, or other <br /> improvement which is publicly owned either within or without the Project Area. <br /> Such payments are subject to the City Coucil's finding all of the following: <br /> WEST SAN LEANDRO/MACARTFIUR BOULEVARD PAGE 10 <br /> REDEVELOPMENT PROJECT AREA <br /> REV 29 %2239%2259% 32699: 33099;040199;061599611 <br />
