H. The adoption of this interim ordinance is exempt from environmental review under <br /> the California Environmental Quality Act pursuant to Public Resources Code section 21065 based <br /> on the finding that this Ordinance is not a "project" within the meaning of Section 15378 of the State <br /> CEQA Guidelines, because it has no potential for resulting in physical change in the environment, <br /> directly or ultimately. This Ordinance does not, in itself, allow the construction of any check - cashing <br /> businesses and therefore, has no potential for resulting in physical change in the environment, <br /> directly or ultimately. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br /> follows: <br /> Section 1. Findings. <br /> The City Council of the City of San Leandro does hereby find as follows. <br /> A. The City Council hereby finds that for the following reasons there is a current <br /> and immediate threat to the public peace, health, safety ancl welfare of its citizens: <br /> (1) The check - cashing uses listed in this ordinance may be subject to <br /> additional regulation which is under consideration by the City. <br /> (2) The City Council finds that, if not properly monitored, check cashing <br /> businesses create the following deuimental effects on the health, safety and welfare of the City: <br /> (a) The proximity and concentration of check- cashing businesses <br /> in a retail center can have a deuimental effect on retail by reducing foot traffic and creating retail <br /> "dead- space." <br /> (b) Many of the services provided by these businesses are <br /> duplicative of services provided by existing businesses and thus do not provide an essential <br /> neighborhood service. <br /> (c) New types of check - cashing businesses, such as ones offering <br /> deferred deposit, have developed quickly in recent years and the existing zoning standards do not <br /> reflect the current state of the industry. <br /> (d) Check - cashing businesses are locating in San Leandro at a <br /> high -rate, thus making it impossible for staff to fully analyze the effects on the community. <br /> B. For the reasons set forth above, the City Council further finds that the <br /> approval of use permits, variances, building permits or other applicable entitlements for these uses <br /> would result in the threat set forth above to the public peace, health, safety and welfare of its citizens. <br /> 2 <br />
