k <br /> IN.THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 99- 029 (1120) <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> APPROVING AMENDMENT NO. 4 TO THE <br /> ALAMEDA COUNTY /CITY OF SAN LEANDRO REDEVELOPMENT PLAN <br /> TO EXTEND THE POWER OF EMINENT DOMAIN TO A <br /> LIMITED NUMBER OF COMMERCIALLY AND INDUSTRIALLY <br /> ZONED PROPERTIES WITHIN THE PROJECT AREA <br /> RECITALS <br /> WHEREAS, the City of San Leandro adopted the Alameda County /City of San <br /> Leandro Redevelopment Plan ( "Plan") on July 11, 1993; and <br /> WHEREAS, the Plan was amended by Ordinance No. 94 -017, Ordinance No. <br /> 95 -039, and Ordinance No. 96 -04; and <br /> WHEREAS, the City Council of the City of San Leandro held a public hearing on <br /> September 20, 1999, to consider an amendment to the Redevelopment Plan to extend the <br /> power of eminent domain to a limited number of commercially and industrially zoned <br /> properties within the Project Area; and <br /> WHEREAS, notice of the hearing was published in a newspaper of general <br /> circulation in Alameda County in accordance with Health and Safety Code Sections <br /> 33349(a) and 33361, and a copy of such notice and affidavit of publication are on file <br /> with the City Clerk and Secretary of the Agency; and <br /> WHEREAS, in accordance with Health and Safety Code Section 33349(b) notice <br /> of the Hearing was sent by first class mail to the last -known assessee of each parcel of . <br /> land in the Project Area to the last known address of each addressee, as shown on the last <br /> . equalized assessment roll of Alameda County on August 20, 1999; and <br /> WHEREAS, in accordance with Health and Safety Code Section 33349(c) notice <br /> of the Hearing was sent by first class mail to all residents and businesses within the <br /> Project Area at least thirty days prior to the Hearing, on August 20, 1999; and <br /> WHEREAS, in accordance with Health and Safety Code Section 33350, each <br /> assessee whose property would be subject to acquisition by purchase or condemnation <br /> under the Redevelopment Plan was sent a statement to that effect included in the notice <br /> of the hearing; and <br /> WHEREAS, a community work was held on September 8, 1999, to provide <br /> an opportunity for the public, including property owners and business operators, to obtain <br /> information about the proposed amendment; and <br /> 1 <br />
