IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 99 -030 (S2028)7 <br /> AN ORDINANCE ADDING TITLE II CHAPTER 14 TO THE SAN LEANDRO <br /> MUNICIPAL CODE ESTABLISHING THE DOWNTOWN SAN LEANDRO <br /> BUSINESS IMPROVEMENT DISTRICT <br /> The City Council of the City of San Leandro does ORDAIN as follows: <br /> Section 1. The City Council of the City of San Leandro finds as follows: <br /> A. On September 7, 1999, the City Council of San Leandro, on behalf of the City <br /> of San Leandro ( "City ") adopted Resolution No. 99 -137 ( "Resolution ") declaring its <br /> intention to establish a Business Improvement District ( "District ") to levy a benefit <br /> assessment on all businesses, trades, professions, and vendors within said District, the <br /> proceeds of which shall be used for the public purposes herein described to benefit the <br /> businesses in the District, pursuant to the Parking and Business Improvement Area Law <br /> of 1989, Part 6 (commencing with Section 36500) of Division 18 of the California Streets <br /> and Highways Code ( "Act "). <br /> B. Pursuant to the Act and the Resolution, City conducted a public hearing, after <br /> having given due notice thereof as required by law on October 4, 1999, at 7 p.m., at City <br /> Hall, 835 East 14th Street, San Leandro, California. <br /> C. Said public hearing has been held and the City Council has heard and <br /> considered all oral and written protests and other comments regarding such proposed <br /> actions. <br /> D. Protests in writing from businesses in the proposed District paying 50% or <br /> more of the proposed assessment have not been received. <br /> E. This City Council has now determined to establish the proposed District as a <br /> Parking and Business Improvement Area to provide for the imposition of a benefit <br /> assessment and to adopt an ordinance to such effect. <br /> F. The proposed district will be voluntary in that persons paying an assessment <br /> will not suffer any liability for failure to pay and will not receive a benefit. <br /> G. In the opinion of this City Council the businesses within the District who pay <br /> the assessment will be benefited by the expenditure of the funds raised by the assessments <br /> levied hereby in the manner prescribed herein. <br /> 1 <br /> • <br />
