IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 99-034 (1007) <br /> AN ORDINANCE VACATING A PORTION OF PERALTA AVENUE <br /> FROM THE UNION PACIFIC RAILROAD /BART RIGHT -OF -WAY <br /> TO THE MOST WESTERLY END <br /> Recitals <br /> The City Council of the City of San Leandro. on November 1, 1999, passed its <br /> Resolution of Intention No. 99 -159 to vacate a portion of Peralta Avenue hereinafter <br /> described. <br /> A public hearing was set for December 6, 1999, at which time any person objecting to <br /> such vacation was given the opportunity to appear and show cause why such vacation should <br /> not be ordered, and notice of such meeting was duly published and posted. <br /> Such hearing was held by the City Council on December 6. 1999. and the City Council <br /> at the time of such hearing, determined that the said portion of Peralta Avenue is unnecessary <br /> for present and prospective public use. <br /> NOW, THEREFORE. the City Council of the City of San Leandro does ORDAIN as <br /> Follows: <br /> Section 1. That the portion of Peralta Avenue located within the City of San <br /> Leandro, Alameda County, California, is unnecessary for the present or prospective public use <br /> and said portion of Peralta Avenue is hereby vacated and abandoned, said portion of Peralta <br /> Avenue is more particularly described in Exhibit "A ", attached hereto and made part hereof. <br /> Reserving and excepting therefrom, until such time as all utilities are relocated outside <br /> the area proposed to be reserved and excepted, of easement and rights -of -way to construct, <br /> maintain. operate. replace, remove, renew and enlarge sanitary sewers, storm drains and <br /> • <br />
