• <br /> Tow Service 50.00 + 1.00 Per $1,000 of <br /> Gross Receipts" <br /> SECTION 2. If for any reason the provisions of this Ordinance are <br /> suspended or held invalid in whole or in part by a court of competent jurisdiction or <br /> if the provisions of Section 1 hereof fail to become operative, then in such instance <br /> the terms, conditions and provisions of Chapter 2 of Title 11 of the San Leandro <br /> Municipal Code or applicable portion thereof in effect immediately prior to <br /> November 6, 1995, shall become operative and effective. <br /> SECTION 3. This Ordinance is hereby declared to be an urgency <br /> ordinance and pursuant to San Leandro Municipal Code Section 1- 1- 345(d) shall <br /> take effect immediately because it is related to business license classifications and fees <br /> for the usual and current expenses of the City. Notwithstanding this Section 3, the <br /> provisions of Section 1 hereof shall be operative when and if approved by the <br /> electorate in accordance with Article XIIIC of the California Constitution. The fees <br /> imposed on the issuance of business licenses or on business classifications shall be as <br /> set forth in Section I hereof from and after the operative date of Section I and <br /> Section 1 shall have no retroactive application. Any action to challenge the fees <br /> imposed by this Ordinance shall be brought pursuant to Government Code Section <br /> 50077.5.
