C. Design Standards. Per Zoning Code Section 2 -700E, the purposes of the <br /> industrial district regulations include ensuring that "the appearance and effects <br /> of industrial uses are compatible with the character of the area in which they <br /> are located." The Zoning Enforcement Official shall review and approve all <br /> plans and elevations of buildings housing adult- oriented businesses to <br /> determine whether they meet this standard. This review will consider building <br /> color, massing, architectural features and other exterior details. A decision on <br /> this design compliance for a for a new business shall be given within 30 days of <br /> the granting of an Adult - Oriented Business Regulatory Permit; any changes to <br /> the exterior of the building after the initial review shall also be subject to <br /> review and approval by the Zoning Enforcement Official. <br /> D. Appeal. Any decision of the Zoning Enforcement Official made pursuant to <br /> this Article may be appealed to the Planning Commission pursuant to Article <br /> 28. Any administrative action made pursuant to this Article may be appealed <br /> to a court of competent jurisdiction. <br /> SECTION 15: SEVERABILITY. If any section, subsection, subdivision, <br /> sentence, clause, or phrase in this chapter or any part thereof is for any reason held to <br /> be unconstitutional or invalid, ineffective by any court of competent jurisdiction, <br /> such decision shall not affect the validity or effectiveness of the remaining portions of <br /> this chapter or any part thereof. The City Council hereby declares that it would have <br /> passed each section irrespective of the fact that any one (1) or more subsections, <br /> subdivisions, sentences, clauses, or phrases be declared unconstitutional, invalid, or <br /> ineffective. <br /> 12 <br />
