SECTION 9: The San Leandro City Council recognizes the potential <br /> harm to minors associated with the adverse side - effects of Adult - Oriented Businesses <br /> and the importance of maintaining a community that is safe and secure for children. <br /> The City Council desires to minimize and control such adverse secondary side - effects <br /> and thereby protect the health, safety and welfare of San Leandro residents, protect <br /> citizens from increased crime, preserve the quality of life, preserve property values <br /> and the character of surrounding neighborhoods and businesses, deter blight, and <br /> protect against health threats from the spread of communicable and sexually <br /> transmitted diseases. <br /> SECTION 10: It is not the intent of the San Leandro City Council in <br /> enacting this ordinance, or any provision thereof, to condone or legitimize the <br /> distribution of obscene material, and the City recognizes that state law prohibits the <br /> distribution of certain materials and expects and encourages law enforcement officials <br /> to enforce state obscenity statutes against such illegal activities within the City of San <br /> Leandro. <br /> SECTION 11: Nothing in this ordinance is intended to authorize, <br /> legalize, or permit the establishment, operation, or maintenance of any business, <br /> building, or use which violates any City ordinance or any statute of the State of <br /> California regarding public nuisances, unlawful or indecent exposure, sexual conduct, <br /> lewdness, obscene or harmful matter, or the exhibition or public display thereof. <br /> • <br /> SECTION 12: ZONING PROVISIONS RESCINDED. The City Council <br /> hereby amends the San Leandro Zoning Code by rescinding Article 2 -634 (B) <br /> allowing Adult- Oriented Businesses with a Conditional Use Permit in the CG <br /> District. The City Council hereby further amends the San Leandro Zoning Code by <br /> rescinding the following definitions in Article 1 -304: <br /> (a) Adult Entertainment Establishments, including (A) Adult Bookstore, <br /> (B) Adult Motion Picture Theater, (C) Adult Theater, and (D) Other <br /> Adult - Entertainment Establishments; <br /> (b) Areas, Specified Anatomical <br /> (c) Sexual Activities, Specified <br /> SECTION 13: ZONING DEFINITIONS AND PERMITTED USES <br /> ADDED: The City Council hereby amends the San Leandro Zoning Code by adding <br /> Article 2 -704 (EE) allowing Adult- Oriented uses as a permitted use in the IL District; <br /> 5 <br />
