_ 1 <br /> IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDNANCE NO. 97 -029 (1078/1934) <br /> AN ORDNANCE AMENDING SECTIONS 3 -6 -105 AND <br /> 3 -6 -110 OF THE SAN LEANDRO MUNICIPAL CODE <br /> RELATING TO GARBAGE AND RECYCLING <br /> The City Council of the City of San Leandro does ORDAIN as follows: <br /> Section I. Section 3 -6 -105 is hereby amended to read as follows: <br /> "Section 3 -6 -105: FINDINGS. <br /> It is hereby found and determined that the periodic collection of garbage from all <br /> property in the City of San Leandro in, upon, or from which garbage is produced or accumulated <br /> is essential for the maintenance of the public health and welfare of the City of San Leandro and <br /> that the provision by the City of San Leandro of such garbage collection service is a direct benefit <br /> to all such property and to the owners and occupants thereof <br /> It is further found and determined that the recycling of recyclable materials is <br /> necessary and desirable to protect the public health, safety and welfare by reusing valuable <br /> resources, reducing the waste stream to existing landfills and reducing environmental harm <br /> resulting from the disposal of solid waste." <br /> Section 2. Section 3 -6 -110 is hereby amended to read as follows: <br /> "Section 3 -6 -110 REQUIRED GARBAGE DISPOSAL THROUGH CITY <br /> SERVICE OR FRANCHISEE: RESIDENTIAL RECYCLING. <br /> Every person in possession or control of any property in the City of San Leandro <br /> in, upon or from which garbage is produced or accumulated shall dispose of such garbage through <br /> the regular garbage collection service of the City or a garbage hauler franchised by the City to <br /> collect said garbage. Every person in possession or control of any residential property in the City <br /> of San Leandro in, upon or from which recyclable materials are produced or accumulated shall <br /> recycle recyclable materials through a recycling contractor authorized to conduct business in the <br /> City." <br /> Section 3.
