EXHIBIT A <br />VESSEL PUMPOUT FACILITY INSTALLATION CONTRACT <br />REIMBURSEMENT <br />CITY OF SAN LEANDRO MARINA <br />1. GRANT <br />(a) The DEPARTMENT will make a grant up to the amount of SEVENTEEN THOUSAND <br />DOLLARS ($ 17,000.00), to the GRANTEE, for installation of vessel pumpout facilities at <br />the San Leandro Marina in accordance with EXHIBIT B. The grant shall not exceed this <br />amount. <br />(b) The grant provides that the PROJECT COSTS shall be reimbursed with Federal Funds [FED <br />CATAL0615.616]; <br />2. PROJECT COMPLETION DATE <br />The GRANTEE shall complete the installation of the vessel pumpout facility (such installation as <br />described in the Clean Vessel Act Grant Application dated September 18, 2001, and hereinafter <br />referred to as PROJECT) no later than September 18, 2002. <br />3. TERM OF CONTRACT <br />(a) The term of this CONTRACT, subject to the provisions for prior termination, shall begin on <br />the effective date of the CONTRACT and shall continue for SEVEN (7) years from such date. <br />(b) This CONTRACT may be extended, amended or canceled upon agreement of both the <br />DEPARTMENT and the GRANTEE. <br />4. USERS FEES <br />The GRANTEE may charge a fee for the use of the facilities constructed with the GRANT; however, <br />such fees may only be used to defray operation and maintenance costs incurred from the operation of <br />the vessel pumpout facility. The GRANTEE may charge a total fee in excess of $5.00 for the use of <br />the pumpout facilities constructed; the $5.00 fee may be increased or decreased annually in accordance <br />with percentage changes in the United States Bureau of Labor Statistics Consumer Price Index (CPI) <br />using the CPI index for December 1993 (436.8) as the base for any such adjustment. <br />1 <br />
