IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2000 - 36 (1120/1313-B) A RESOLUTION OF THE CITY COUNCIL APPROVING THE REUSE REPORT REQUIRED BY HEALTH AND SAFETY CODE SECTION 33433 FOR THE PROPERTY LOCATED AT 1948 DAVIS STREET, (APN 077A- 0675 -017), PLAZA 2 REDEVELOPMENT PROJECT AREA FOR CONSTRUCTION OF AN AUTOMOTIVE SERVICE CENTER; AND THE DISPOSITION AND DEVELOPMENT AGREEMENT (DDA) BETWEEN THE SAN LEANDRO REDEVELOPMENT AGENCY, MICHAEL BROOKS, LEONARD BRUNO AND JOHN THOMAS PEREIRA RECITALS WHEREAS, the Redevelopment Agency (the "Agency ") has negotiated a Disposition and Development Agreement ( "Agreement ") between the Agency and Michael Brooks, Leonard Bruno and John Thomas Pereira (collectively "Developer") to build an automobile services related business at 1948 Davis Street, San Leandro, which will further the purposes of the City of San Leandro Plaza II Redevelopment Plan; and WHEREAS, the Agreement provides for the Agency to convey the Property at 1948 Davis Street, San Leandro (the "Property ") to Developer for consideration in the amount of one hundred eleven thousand eight hundred eighty five dollars (S111,885); and WHEREAS, the Agency has caused to be prepared a report required by the Health and Safety Code § 33433 ( "Reuse Report") which contains a summary of the proposed Agreement to be entered into between the Agency and Developer and a summary of the cost of the Agreement to the Agency; and WHEREAS, the summary of the cost of the Agreement includes: the Agency's original land acquisition costs, the estimated value of the interest to be conveyed determined at the highest and best uses permitted under the project plan, the estimated value of the interest to be conveyed determined at use with conditions, covenants, and development costs required by the sale; and an explanation of why the sale of the property will assist in the elimination of blight; and WHEREAS, the Agency has made the Reuse Report available for public inspection pursuant to Health and Safety Code § 33433; and WHEREAS, the Agency has held a properly noticed public hearing and taken all other actions required by law to prepare and present the Reuse Report; and WHEREAS, the Council does hereby take official notice of all documents, surveys, records and reports maintained in the ordinary course of business by the Agency and the City of San Leandro relating to the real property that is the subject of the Reuse Report, and the Council has considered the report and recommendations regarding the Reuse Report, and has provided an opportunity for all persons to be
