IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2000 - 36 (1120/1313-B) <br /> A RESOLUTION OF THE CITY COUNCIL APPROVING <br /> THE REUSE REPORT REQUIRED BY HEALTH AND SAFETY CODE SECTION 33433 FOR THE <br /> PROPERTY LOCATED AT 1948 DAVIS STREET, (APN 077A- 0675 -017), PLAZA 2 REDEVELOPMENT <br /> PROJECT AREA FOR CONSTRUCTION OF AN AUTOMOTIVE SERVICE CENTER; AND THE <br /> DISPOSITION AND DEVELOPMENT AGREEMENT (DDA) BETWEEN THE SAN LEANDRO <br /> REDEVELOPMENT AGENCY, MICHAEL BROOKS, LEONARD BRUNO AND JOHN THOMAS PEREIRA <br /> RECITALS <br /> WHEREAS, the Redevelopment Agency (the "Agency ") has negotiated a Disposition and <br /> Development Agreement ( "Agreement ") between the Agency and Michael Brooks, Leonard Bruno and <br /> John Thomas Pereira (collectively "Developer") to build an automobile services related business at 1948 <br /> Davis Street, San Leandro, which will further the purposes of the City of San Leandro Plaza II <br /> Redevelopment Plan; and <br /> WHEREAS, the Agreement provides for the Agency to convey the Property at 1948 Davis Street, <br /> San Leandro (the "Property ") to Developer for consideration in the amount of one hundred eleven <br /> thousand eight hundred eighty five dollars (S111,885); and <br /> WHEREAS, the Agency has caused to be prepared a report required by the Health and Safety <br /> Code § 33433 ( "Reuse Report") which contains a summary of the proposed Agreement to be entered into <br /> between the Agency and Developer and a summary of the cost of the Agreement to the Agency; and <br /> WHEREAS, the summary of the cost of the Agreement includes: the Agency's original land <br /> acquisition costs, the estimated value of the interest to be conveyed determined at the highest and best <br /> uses permitted under the project plan, the estimated value of the interest to be conveyed determined at <br /> use with conditions, covenants, and development costs required by the sale; and an explanation of why <br /> the sale of the property will assist in the elimination of blight; and <br /> WHEREAS, the Agency has made the Reuse Report available for public inspection pursuant to <br /> Health and Safety Code § 33433; and <br /> WHEREAS, the Agency has held a properly noticed public hearing and taken all other actions <br /> required by law to prepare and present the Reuse Report; and <br /> WHEREAS, the Council does hereby take official notice of all documents, surveys, records and <br /> reports maintained in the ordinary course of business by the Agency and the City of San Leandro relating <br /> to the real property that is the subject of the Reuse Report, and the Council has considered the report and <br /> recommendations regarding the Reuse Report, and has provided an opportunity for all persons to be <br />
