• EXHIBIT EGENERAL FEDERAL /STATE CONDITIONS <br /> COMMUNITY DEVELOPMENT BLOCK GRANT <br /> (Service Agreement) <br /> 1. GOVERNMENTAL REGULATIONS. To the extent that this Agreement may be funded <br /> by fiscal assistance from another governmental entity, Port shall comply with all applicable rules <br /> and regulations to which City is bound by the terms of such fiscal assistance program. In <br /> particular, Port agrees to comply with all applicable provisions of the Housing and Community <br /> Development Act of 1974 (Public Law 93 -383) and regulations promulgated pursuant thereto. <br /> ?. RECORDS. Records must be kept accurate and up -to -date. Pores records shall be made <br /> available for review by the City HUD or their designee. Port shall be responsible to maintain, for <br /> not Tess than three (3) years after completion of this Agreement, all records pertaining to this <br /> Agreement, including subcontracts and expenditures, and all other financial and property records. <br /> 3. AUDITS AND INSPECTIONS. <br /> A. Port shall at any time during normal business hours and as often as the City, HUD <br /> and the Comptroller General of the United States may deem necessary, make available to their <br /> representatives for examination all of Port's records with respect to all matters covered by this <br /> Agreement and shall permit these representatives to audit, examine and make excerpts or transcripts <br /> from such records, and to make audits of all documents and conditions relating to this Agreement. <br /> All costs are subject to the eligibility requirements of HUD. <br /> B. Port shall permit and facilitate observation and inspection of the work and records at <br /> Port's principal office and job site by City, its employees and public authorities during reasonable <br /> business hours. <br /> 4. EQUAL EMPLOYMENT OPPORTUNITY. <br /> A. Affirmative Action in Employment <br /> 1. Port shall comply with the Affirmative Action Program and Equal <br /> Employment requirements of the State and Federal Government. <br /> 2. During the performance of this Agreement, Port agrees as follows: <br /> a. Port will not discriminate against any employee or applicant for <br /> employment because of race, color, religion, sex, sexual orientation, <br /> handicap, age, or national origin. Port will take affirmative action to <br /> ensure that applicants for employment are employed, and that <br /> employees are treated during employment, without regard to their <br /> race, color, religion, handicap, sex, sexual orientation, age, or <br /> national origin.
